I got the e-mail from NMSSA and sent emails to the committee members:

“Dear Senators and Committee Members,

I am a New Mexico resident living in *** County, and I urge you to oppose SB17, in whole and in part.

This burdensome and unconstitutional measure will do nothing to control or impact violent crime in our state, and worse, will obligate New Mexicans to pay for years of courtroom legal battles, as the gun and magazine bans and other requirements clearly do not meet the Bruen standard as determined by the Supreme Court of the United States.

Finally, as it is similar to bills appearing in other states, I am quite certain it was drafted by lobbyists, and suspect a FOIA request would reveal it was drafted by folks at Everytown or a similarly billionaire-funded organization.

New Mexicans don’t need outsiders writing bad laws that only restrict the rights of law-abiding citizens; we need to enforce our laws and charge, try and incarcerate violent criminals.

There's a bunch of filth in this legislation hiding under the guise of stopping arms trafficking and compliance nightmares for dealers.  

But this is the worst part.  They also define "gas operated" in the most retarded way it includes blowback and any semi auto action.  

It doesn't appear to ban possession. Yet anyway. That will surely come next session. But it sure looks like this would ban any handgun that isn't a revolver, making it stricter then even California.  And can basically every repeating rifle on the market.

  SECTION 7. A new section of Chapter 30, Article 7 NMSA 1978 is enacted to read:

    "[NEW MATERIAL] PROHIBITING THE SALE OF EXTREMELY DANGEROUS WEAPONS.--

         A. Beginning on July 1, 2026, a dealer shall not sell or transfer any of the following firearms, ammunition or devices to a person who is not licensed pursuant to 18 U.S.C. Section 923, nor shall a dealer process a background check pursuant to Section 30-7-7.1 NMSA 1978 for the transfer of any of the following firearms, ammunition and devices between parties that are not licensed pursuant to 18 U.S.C. Section 923:

               (1) a detachable magazine that holds more than ten rounds of ammunition;

               (2) a .50 caliber rifle;

               (3) a .50 caliber cartridge;

               (4) a gas-operated semiautomatic firearm that can accept a detachable magazine;

               (5) a gas-operated semiautomatic firearm with a fixed magazine that holds more than ten rounds of ammunition; or

               (6) a machine gun.

         B. The provisions of Subsection A of this section do not apply to the sale of:

               (1) a firearm designed to accept, and capable of operating only with, .22 or less caliber rimfire ammunition;

               (2) an antique firearm; or

               (3) a firearm that:

                    (a) is a single-shot rifle, shotgun or handgun;

                    (b) is a breech-loading rifle, shotgun or handgun with a capacity not to exceed two rounds of ammunition;

                    (c) is a muzzleloading rifle, shotgun or handgun;

                    (d) is a bolt-action rifle, shotgun or handgun;

                    (e) is a lever-action or pump-action rifle or shotgun;

                    (f) is a single- or double-action semiautomatic handgun that uses recoil to cycle the action of the handgun; or

                    (g) has a fixed magazine with a capacity not to exceed ten rounds of ammunition.

         C. The provisions of Subsection A of this section do not apply to the sale or transfer of a firearm or device to:

               (1) a law enforcement agency in the state, the United States armed forces, the New Mexico national guard or the New Mexico state defense force;

               (2) an Indian nation, tribe or pueblo or an agency or political subdivision thereof;

               (3) a licensee under Title 1 of the federal Atomic Energy Act of 1954 or its contractor for purposes of establishing and maintaining an on-site physical security protection system and security organization required by federal law or the transfer to a site; or

               (4) a dealer, distributor or manufacturer licensed under 18 U.S.C. Section 923."

As a law-abiding, productive resident of New Mexico for over 40 years, I would like to express my concerns about SB 17.  This arbitrary bill proposal is blatantly unconstitutional and directly disregards our 2nd Amendments rights.  How is it judiciously prudent to put forth proposed legative bills that are clearly violates the Constitution of the United States of American based upon political ideology?

As a tax-paying constituent, I strongly urge you to vote against this erroneous bill.  By the passage of this bill, law-abiding citizens of New Mexico will be targeted which does not address the issue of decreasing crimes rates in New Mexico.  Furthermore, there is no non-bias burden of proof that banning large capacity magazines and/or assault rifles reduces the number of violent crimes committed. I understand the reduction of violent crimes is a cause for concern but strictly targeting law abiding citizens with absurd manufactured ideas of what stricter gun regulations should is completely unjust and unlawful.  

Most importantly, SB 17 unmistakably is in violation of the Second Amendment.   The appalling restrictions proposed in SB 17 infringes on the right to keep and bear arms.  With SB 17’s complete disregard for the Second Amendment, could set a precedent for further disregard to other Constructional rights.  Thus, leading to a complete collapse of individual inalienable rights and freedoms designed to protect and secure liberties for United States citizens from government outreach.  What does the future look like when the foundational structure of the federal government is being ignored by states government.


So, again, I strongly urge you to vote against SB 17 for a successful, sustainable, beautiful future for New Mexico.

I advanced the argument that another measure my rep supports (HB 318) would render legislators subject to civil suit, since the measure is plainly unconstitutional (State/Fed) and would commit our slender resources to years of defending it in the courts…

They will vote the party line to save the children, three-legged cats, and transgendered goldfish.

As in other states, if you are not buying parts, spares, bulk ammo, 80%s… they’ll come for all that next, then pursue “training” and renewable gun owner licenses.

It isn’t the business as usual era anymore; we’ve seen Washington, Colorado, and now Virginia slide towards abrogation of our rights. They’d love to add us to the list.

I'm surprised this made it to a floor vote....even more surprised that is actually passed.  The narrative  is more of the provisions for dealers than the actually ban itself, the dems finally figured out how to word a bill to get it through.  The house will have a little less than two weeks to get this into committees, bring to a floor vote, and actually pass it.

If it doesn't pass this year then what?  You have twelve months until they try again in 2027 during the 60-day session?  The NM legislature is isn't what it once was.  It is now in line with other progressive states, maybe a few years to a generation behind.  It only gets worse from here.

You're right. It was only a matter of time before the "old-school" democrats in the NM legislature got replaced or fell in line with the progressive ones. Nothing short of the tenth circuit or SCOTUS ruling in gun owners' favor will put this nonsense to bed. What's unique about NM compared to other blue states is how unappealing it is to stay or move there. High taxes, crime, lack of healthcare providers, apathetic law-makers, and soon the inability to buy commonly owned firearms. It's become the testing ground for the worst policies and the statistics show it. They'll keep shoveling out shit each year without a care for the people scraping by.

My understanding of the house is it's a slam dunk there. So I like this idea of running out the clock.  

I'm still pissed off Cervantes pulled the shit he did.  He stated it's unconstitutional, then voted to pass it out of his own committee he controlled with a "do pass" recommendation. Then voted against it on the floor after he knew it would pass.   This so he can claim he was against it even though he personally got it through to the Senate. What a chickenshit asshole.

Not law yet. It has to go to the house now. They don’t have long, session ends Feb. 19th. I fully expect them to ram this shit home in the wee hours just before everyone goes home. Hopefully there a few dims left with sanity & they’ll kill it there before they Hail Mary it.

Just for clarity on what to expect today - the vice chair, Janelle Anyanonu, voted "No" on HB61 which would  increase penalties for aggravated battery on police officers and also no on HB49 to increase penalties for felons with a firearm.  

That is what we are up against.

One of the members last night, De La Cruz was touting how excited he was to see this debated on the house floor.  More than likely it will pass judiciary and a floor vote.  I've been saying for years the progressives will finally win and 2026 looks to be their year to win.

I really believe that the average New Mexican wants to be babysat by the government.  I wish I could go back in time and see what the west was like before the Californians invaded and destroyed everything.   The older guys told me what the West used to be like.  It meant freedom, not what is happening now.

It's genuinely tragic the direction NM and Colorado have gone in the last 15 years. I absolutely love both states, but the societal aspect is not the same as it was when my parents were growing up. The best part about the Rockies is the freedom and rugged beauty of it all, but that's being eroded with terribly policy.

That's what originally peak my interest in moving to CO around 2002.  I had never even considered NM until my job brought me here in 2006.  

I don't remember much of Richardson, but he seemed to be pretty moderate in the world of dems and gun control.  Then we had Martinez in which there was really no concern about any gun control especially with most of the state legislature consisting of moderates.  At least to me they seemed moderate.... Well I've done all I can today.  I've emailed and called  the HJC committee. Our only hope is the GOP will delay all the legislation for the last 3 days to stall the late vote on SB 17. Remember theses commies have other bills in front of SB 17. SB 17 is just a stick in our eye, they are really busy socialist assholes wasting money on lowlifes in Norther NM.

I'll contact Zac with NMSSA and find out exactly how I can donate so, that every last cent will go to the legal fight 100%.

I was an FFL for 31 years and know a few small time FFLs. The one I use says he will not do it. It cost too much no ROI.

Maybe this will wake up people that don't give a shit to vote. If we could get the registered GOP to vote in CD2 we would not have a Juarez Mexican as a US Rep. Now I learn that Senator Lujan is running unopposed. Thanks GOP NM, stupid MFKRS.

I have return receipt and delivery notification options on my emails to NM legislators.  I have seen one return receipt. Zero responses. This includes our wonderful GOP.  i just email the entire house so well see what happens now.

I just received  a response from Bill Hall tonight.  He's a republican, so him voting NO doesn't change the balance of power for the Ds on that committee, but at least he responded even if it is a canned response.

The house is still in session on the floor debating HB287 at the moment.  They were on one of the abortion reporting bills earlier.  At this rate I doubt the judiciary committee will meet tonight as it is almost 8pm, unless they decide to pull an all nighter.

Update - 2047 and they're still on the house floor; 2131 and still at it.

Also found this from the Los Alamos daily post.  This section of SB17 was part of a broader article of what the remaining priorities are.  Interesting to see that even the executive direction of NM to Prevent Gun Violence has concerns with the bill.

"The fate of Senate Bill 17, which would ban the sale of “extremely dangerous weapons” and impose an array of security requirements on gun dealers to curb firearms trafficking, is unknown. As of Friday, it had yet to be scheduled for a hearing in the House Judiciary Committee.
Miranda Viscoli, executive director of New Mexicans to Prevent Gun Violence, said the organization supports the sponsors’ goals, but the legislation is “legally vulnerable and likely to backfire.”

“By passing a ban this broad, we are handing the U.S. Supreme Court a perfect opportunity to deliver a definitive, nationwide ruling against state-level firearm restrictions,” she said. “Beyond the legal risk, the bill’s immediate effect will likely be a surge in panic buying of the exact weapons this bill is trying to limit.”

During her State of the State address, the governor also urged the Legislature to pass legislation cracking down on juvenile crime and making it easier to jail violent offenders before their trial, as well as new gun control laws that Republicans vehemently oppose. The governor has struggled to persuade Democratic lawmakers to adopt her public safety agenda.

Well that's sort of promising.  Even if it's for the wrong reasons. I can't figure out if it actually got to the committee tonight or not.  Only a few more days of the session, maybe we can run the clock out on this one as a previous poster mentioned.
