Just got this from GOA. Anyone else called yet? Attorney General Jonathan Skrmetti is wasting no time trying to overturn your Second Amendment rights. After a Tennessee court struck down the state's unconstitutional "Going Armed" and "Parks" statutes in Hughes v. Lee, his office rushed to appeal the decision. Even worse, he asked the court to issue a stay so those laws could remain in force while the appeal dragged on. The court rightly rejected that request, but the appeal itself is still alive, and Skrmetti is doubling down. The Office of the Attorney General just filed an emergency motion for stay pending appeal, yet again trying to keep these unconstitutional restrictions on the books while they try to challenge our big win. Even worse, the arguments being made are downright insulting. Skrmetti's office told the court that without these unconstitutional statutes, there would be: No law stopping children from bringing rifles to a basketball game. Tennessee law already restricts furnishing firearms to minors and criminalizes reckless endangerment. (Tenn. Code Ann. § 39-17-1303; § 39-13-103) No law preventing drunks from wandering Nashville with shotguns. Tennessee already criminalizes public intoxication and reckless conduct with firearms. (Tenn. Code Ann. § 39-17-310; § 39-13-103) No law against fans wearing grenade bandoliers at a little league game. Grenades are already explicitly banned statewide as "explosive weapons" under Tennessee law. (Tenn. Code Ann. § 39-17-1302; § 39-17-1301(6)) These are scare tactics, not serious legal arguments. The Attorney General is using fearmongering to keep unconstitutional laws on the books, and that is not what Tennesseans elected him to do. The court struck these laws down for a reason. They are unconstitutional, and no amount of fearmongering will change that fact.
