The Director of the BATFE publicly stated they will respect the injunction and will not attempt to prosecute anyone covered under law: Attached File It was discussed around page 166 of this thread: https://www.ar15.com/forums/general/Federal-Court-Strikes-Down-NFA-Registration-on-untaxed-firearms/5-2853946/&page=166 At least 4 FFLs have passed their ATF audits after selling suppressors without Form 4s. For customers who are not GOA members, some FFLs are choosing to require approved Form 4s while others are still transferring on Form 4s only for everyone. Others are complying with the injunction. I understand Americans disagree. For example, many Americans believe the 2A only applies to a “militia” and that means the National Guard, so all civilian-owned guns are illegal (those people are wrong, but still allowed to have an opinion). The law does not say what you are allowed to do; it only states what you are prohibited from doing. The injunction is clear, and there are no suppressor ownership impediments in the Commonwealth of Virginia (yet). If you are not comfortable with owning a suppressor without an approved Form 4, that’s your choice and your right not to own one. |
