OK.  This looks like what is happening.  I could be wrong.  But that has happened only once and it wasn't my fault.

Good luck AK47.net!

I suspect Goonsnet is already firing up the phone calls to its lawyers, etc., so I don't expect this fight to be over just yet...

It would be funny if it turns out that AK47.net's domain name was registered before Goonsnet's AK-47.net, and the Goons have to change THEIR name.

(No way I can verify it since I've been banned from the Forbidden Zone).

All of that is fine and good, but I don't think we should have any airsoft AKs in the banner/logo thing.  The two on the right are Airsoft AKs.  Note the area between the selector and the top cover.

I've seen my fair share of Tokyo Marui AK-47s and that's one, and since the one next to it was photographed with it, I'm pretty sure that's there AKS-47 version.

Don't mean to be picky, but hey... toy guns man.

Why would their be any dispute over the doamin names?  AK47.net is strictly differnt than AK-47.net.  The difference is large when it comes to IP address.  The mere fact that it looks similar is no basis for any infringements, unless they already own it.

I agree that Airsoft guns have no place on a banner.  That would just be something else that the idiots at gunsnet would bitch about.

Because the Goonsnet is run by a power-mad dictator who has allowed his delusions of Godhood to become the sole motivating force in his life.

Yes, I was "gotten" a couple of weeks ago when I dared to stand my ground and dispute their "reasons" why they weren't going to allow discussions of K-VAR and Arsenal anymore.  They didn't have an answer to some of my questions and suggestions, so they just deleted the thread, after admitting that the First Amendment doesn't apply there.

I think I got banned after they caught me posting threads at www.gunco.net , which is why I say they'll try to fight over the name AK47.net as well.

I'm just repeating what I've read on this and other forums, but anyone who would try to use internet anti-terrorist legislation to go after someone just because he doesn't like that person's comments about one of his advertisers is ruthless as far as I'm concerned.

Damn straight Zoid. The funny (and I don't mean haha) thing is that I think I was the first one to make the comment on the fact that a firearms board that "supports" the 2nd amendment would infringe upon the 1st. I don't mean that in an arrogant way I'm saying that (yet I don't consider my opinion that important) Is that in a small way I might have contributed to the shit storm. You did a much better job of articulating it than I did, I was merely trying to point out that it is ironic when you consider the fact that the 2nd was inpart created to protect the first.

I knew it wouldn't last long once the domain transfer kicked in and I proudly placed the domain under my name.

Here's the story:

We were looking for a domain name to use for the AK family which has been growing. We still have a few things to nail down, but it's safe to say we're pretty damn happy about AK47.Net landing in our laps. This was a wonderful example of how treating people well and being focused on the community can pay off. This domain was in the hands of a friend who transferred it to us for our coming re-launch.

We official took control of the domain about a week ago and I rushed to throw something up as a "coming soon" page. (Hey we cover airsoft and paintball too ya know! ) Right now the final splash page is in the works and the AK site is fully integrated with AR15.Com and WeaponForums.Com. Our goal is to provide expanding coverage over the AK realm and improve the home we've built for all of you.

Along with this new domain is a LOT of work being done on the site. Most importantly is our moving to a new location to expand our network options. While those at "gunsnet" talk about having bandwidth they don't have or need, we base things on reality here. We've been flooding our lines because of all the traffic for months and each time we add a single T to the mix, it just fills up within a few months. This time, we're making a large investment that we hope pays off, and we're getting the BW you all desire. When we're back with the new site, you should never have to wait for a page to load again!!!!

Finally, as I am the guy who wrote all of the code that runs the site, I've been working on a number of additions, fixes, tweaks to every section here. Having the knowledge and control over every aspect of code makes it simple to do the things we want. Expect a new look, new features, and a much nicer way to spend your time here.

So let the countdown begin for AK47.Net to take flight!

Gunsnet is a spin off of AR15.Com as the people who started that group were disgruntled members who left. They opened gunsnet as an AR-15 site and quickly found out they were alone.

A few years later when Ian was sick of running AK-47.Net they purchased it from him and gunsnet was reborn. They still run an AR site, I believe there are 4 or 5 people who enjoy it very much.

As for Jen's AK board, well the boys at gunsnet just don't know how to play nice, and Jen found herself wanting to help out the community there which has been lied to, abused, and controlled. Jen is a wonderful person, a wonderful admin, and nobody can touch FalFiles. We're on great terms with her and I would do just about anything to help if asked.

FYI - I updated the coming soon page with a little peak of what's coming. That will be what the splash page looks like for the new site and is a little nicer than the one we threw up in our rush!

I can speak a little bit to the trademark issues--- ak-47.net and ak47.net are fairly similar, so there is grounds for a domain name dispute, except for two things:

1. Ak-47 and ak47 are generic terms for products that are sold under a variety of trademarks.
2. The originator of the trade name AK-47 is the State of Russia, and I doubt they have registered it.

A search of the USPTO reveals the following:
o   AK-47 is a registered trademark of "Cold Steel, Inc." in Ventura, CA, and is still valid. The mark covers "sport knives"
o  AK47 is a registered trademark of "London & Oriental Trading Company" in the UK and is live.  The term is for beverages containing alcohol.
o  AK47 is an abandoned, registered trademark for "Firearms and their Components" by "Interport, Inc" of Nevada

Nobody has registered to use this term to cover "net services, discussion groups, online forums" or anything of the like.

IF you want, you can file a trademark with them to reserve "ak47.net" as a mark for your service.

The reason I bring up trademarks is that domain names are first-come, first-served *except* when there's a pre-existing trademark that one might claim is infringed.

So, even though ak-47.net was registered by Chris Stowell, of Denver Colorado on the 28th of January 1999, he would have no claim against ak47.net for infringement since he did not register the trademark with the USPTO.

There are state trade name laws that might come into play here-- but as long as ak-47.net has not been registered as a business name in the state that the owners of ak47.net are located in, then that avenue won't work either.

I'm not a lawyer, but I've had to do some amature trademark clearing work in the past.   I think you're clear from my unfprofessional legal perspective.

Don

PS- Congrats on scoring the domain.  Somehow I found ak-47.net first when I was looking for firearms forums, and I regret wasting the time there that I did.  I'm glad to see good relations between you and Jen and that just reflects well on you guys as businesspeople.

One day boycunt will relize that a free flow of ideas is what makes a forum valuable as an advertising provider, and that this is incompatible with trying to have a monopoly on the topic.  I just hope its as painful as all the pain of the people who sent rifles to Gary Gucciano because of him.
