Can I use TA31 and ARMS#40 at same time? I saw some pictures and found that cowitness can not be done when a TA31 (or TA01) is mounted. If so, why we need a backup sight?

No. ARMS #40 is intended to co-witness with non magnified Aimpoints, Eotechs, and other reflex sights. The TA-31 ACOG needs to be removed to use the ARMS #40. An ARMS #19S will come in handy for quick removal.
