| Okay guys I have a Bushmaster Lower that is stamped 5.56 but I am placing a .300AAC SBR on it. When I fill out my form do I place the Caliber as 5.56 or .300AAC? The local ATF said place .300AAC but thaere is not an option on the eform drop down menu, however 5.56 is. Also, I asked the ATF about just placing 5.56 and then just added a .300AAC upper and he said that would be another tax stamp. He informed me that if I see information saying that you can place any SBR upper on a registered lower that is incorrect!!! You CANNOT change the caliber uppers. He said when they pull up the serial number, all they see is the caliber and if it is different then it would be illegal. Guy was really nice and spent a good bit of time with me but I didn't know that .300AAC was not going to be in the drop down menu after I selected the model. Any advice would be great or I guess I will just give the local ATF a call again. Don't know....... |
| You don't select 300AAC, you just select .30 or 7.62. If you select 5.56, your rifle technically must be first assembled as a 5.56 SBR then you can change the upper as many times as you want. If you can't return it to original configuration, the ATF asks you to send them a letter letting them know the new configuration but it is not required. The ATF guy you spoke with was incorrect or you misunderstood. |

You should probably go ask this question over in the Armory forum. There is a section there for "legal" questions and another dedicated to SBR's.............but, quickly............you don't put down the cartridge, you put down the caliber. .300 AAC isn't the caliber, it is the cartridge. 5.56 is the caliber, just like 7MM would be, or .30 caliber
Another suggestion.........don't ask your local ATF office much of anything...........sounds like they don't know what they're talking about. |

300AAC is a specific cartridge, not a caliber. You need to put .30 Cal. in the caliber section.
No comment on what the ATF guy told you except that the law does not support what he said. However, the SCOTUS has ruled that a policeman's (or this case, an ATF agent) ignorance of the law is acceptable if it is reasonable for them to believe they were following the law. |

That is another point that you have to be careful of, but not exactly related to your question. There are options in the caliber drop down box that ARE NOT ACCEPTED. Kind of crazy, but ATF put everything that has been submitted by people as options even though they won't accept some of the options they offer you. In the caliber drop down box there are examples that are cartridges, not caliber, and if you choose one of those you can/may be denied approval. |

Okay I am going to try that, I am just concerned that since my Bushmaster Lower has engraved on it already 5.56 that they might not accept .30 caliber. |
