What holds it in place?

I am building a .22LR and I don't need the gas tube, but I have a flip-up front sight and standard hand guards.

Does one of the pins hold it against the gas black?

I am using a YHM Hooded Front Flip Sight Tower.

The handguard cap is held against a step cut in the barrel by the FSB.  The gas tube keeps it from rotating, but you can get a short length of the right diameter rod and pin that in if that's what you need.

The hand guard cap at the FSB/Gas block is pinched between the FSB/Gas Block and the Ridge on the barrel.  The hand guard cap can still rotate, the gas tube runs through a hole in the hand guard cap and keeps it from rotating.

If you've got an old gas tube, you could cut it off so that just a 1/4" or so extends out the back of the gas block to go through the HG Cap.  Another option, see if you can get a metal dowel/rod of the right diameter at your local hardware store and drill it for the gas tube roll pin.  Depending on your Gas block, maybe a bolt through it OR tap it and screw a bolt in.

If you were planing on using NO Gas Block or FSB at all, then it becomes tough, you'll have to improvise some sort of collar to secure in front of the hand guard cap.  I just saw on the Yankee Hill Machining Web Site they have a low profile gas block for just $21, that may be a route to go.
