I currently have a Rock River/NFA setup at home and I am wanting to start up an AR pistol. I just bought a complete lower and I am in the process of finding the right upper. The lower I have for the soon-to-be pistol already has the buffer tube and butt stock on it. I bought the lower from a guy on Armslist so it is not registered to in my name.
Can I just remove the butt stock and use the current carbine buffer tube or is this illegal? Thanks boys! |

Depends how it was originally transferred and built up. If it transferred as a complete rifle (with upper) and marked as "Long Gun" on the 4473, then no, you cannot build a pistol out of it. You'd have to SBR it.
I don't know how you would go about finding that information though. |
| You're good to go then! Just take the stock off. Make sure you're being a little cautious about it though, as to where you store the stock (like don't take it with you when you have the pistol out at the range). Don't want to fall into the "constructive possession" bs. |

If the original buyer bought it as a complete lower it's unlikely it was put down as other (stripped) on the 4473. Most complete lowers I've seen being sold with a stock already on it are sold as rifle. I don't know who you would contact, other than the guy you got it from, to find out where it was bought and how it was recorded. Until finding that info out I would not build it into a pistol or it could be the last one you get to build. |
| Some state laws can vary as well, but in most cases, if you purchase as a stripped lower, the dealer/transferrer should have marked it as "other" as previously mentioned. Even if the stripped lower had been completed as a rifle, unless it was then re-registered as such, then it would be difficult for you to prove without prior knowledge from a previous owner as you only received it as a lower. I would definitely find out that it was indeed transferred as other and only as a stripped lower and that it has never been registered as a rilfe. |
