I am in the process of building a 300 bkout pistol. Obtaining parts as I go along and should be done by Christmas. The parts I have are as follows:

Aero stripped lower 7743ed as other and has never been attached to a rifle upper.

Aero upper with no forward assist.
8" White River armory QPQ barrel.
lp gas block and pistol tube.

I am getting the free float handguard soon, 9" utg super slim.

My question is can I install the barrel nut along with he gas tube assembly if I don have he lower completed? I have a completed 223/5.56 rifle with a 16" in my collection and don't want to be in violation of possession intent or whatever they call it. The upper wont have a charging handle or bolt carrier group until the end after the lower is completed. It wont have the KAK flash can either for awhile.

I'm not sure if I can have this pistol upper sitting here less flash can/ch handle and bcg  with its lower still stripped and a completed lower/bcg and charging handle available from my rifle.

If its a no no, I will leave the upper and barrel separated until I get a lpk and pistol buffer tube assembly.

If you have a lower that can be built as a pistol then it does not matter that it has not been built as such yet. Think of the law in this way.  It is illegal ONLY when the only way parts can be assembled is into an illegal firearm. That would be a shorter than 16 inch upper and you only own AR rifles which started out as rifles.  If you have a pistol lower or a lower that is still a virgin 'other' lower then you are legal because it CAN be built into a pistol, even if that lower has not been completed.
