Im know this has been discussed before but I couldnt find the threads...

My question is as follows:

I had heard that the age to buy a lower reciever recently changed or is about to change from 18 to 21.  Is this true, and if so, on what date will/did this change?

Stripped lower or assembled lower with just pistol grip would be 21.  Complete lower with rifle or carbine buttstock would be 18.

All I can figure is it's a state/discression thing.  I bought my stripped receiver at 19.

I am not sure when the change occured.  I think it had something to do with the receiver w/o buttstock being classified as other.

I am pretty sure you could still have the dealer screw the buttstock extension w/ the stock body on it, then unscrew it before you buy it.  It should then be a rifle lower.

My understanding is that a stripped lower can be legally made into a handgun configuration hence not legal for someone under 21.  However since you can't legally take a rifle and convert it to a handgun, lowers that already have a stock on them are rifles and can be purchased by people 18 and over.

If the FFL marks the 4473 'rifle' the lower would then be registered as such and illegal to build into a pistol. Wouldn't that work?

The rules changed with the latest version of the form 4473. You have to be 21 to buy a "frame" or "receiver" as it is listed as "other" (as in, not a long gun or a hand gun) on the form.

It is unrelated to the handgun/long gun thing as far as "registering" it as one or the other. Simply attaching a stock and then transferring it and then taking the stock off also is pretty sketchy. Does that then make your dealer a "manufacturer"? Etc.

p.s. there is no "REGISTERING" of anything as anything in terms of Federal law and the paperwork to buy a gun. I wish that misunderstanding would just go away... especially here on ARFcom.

You have to fill out a form with all your personal information and submit it to the federal government.  If that isn't registration, what is?

here is the Email from the ATF when I mailed them if you are over 18 but under 21 it MUST be a COMPLETE rifle when purchased from an FFL, private sales are different.

"Under Federal regulations, all firearms have a definition.  A rifle (paraphrased): has a rifle bore and is designed to be fired from the shoulder.  A receiver has no rifled bore as it does not have a barrel, further; it has no stock so it can not be fired from the shoulder.  

Since a receiver is not a rifle it can only be transferred to a person who is at least 21 years of age."

The rules did not change they were just made clear(as mud) and new 4473's are being used

You don't really understand the 4473/Brady background check stuff really at all, do you?

No serial numbers, addresses, phone numbers, etc. go to the Feds at the time of a gun purchase.
