I have an AR 15 that I got from a friend and am trying to figure out if it is a "pre-ban". Here is the info on the gun that I know. My friend bought it back in 2001 during the ban. I believe it is a pre-ban it is made this is all the informantion on the reciever

well a pre ban upper is one that has a flash hider, a bayonete lug under the front sight post. a picture would really help.

I do not know TX law, but I think this is a moot question.

Pre-ban is about how the firearm looks, not what it is.



If the firearm was first bought before the ban, then it might have had a flash hider on the end and bayonet lug FSB. At the time of the ban the lug could have been shaved off and a muzzle break added.



Since Texas has no laws on this, the question is more of a "historical" nature about how the firearm was first made. Call EA. There is no law IIRC in Texas requiring you to keep the firearm in a pre-ban configuration, and any past owner could have re-configured a post-ban gun to pre-ban status legally.



When the ban ended, many people removed their non-lug FSB and replaced them with one with a bayo lug, some did not. Same goes for the flash hider / muzzle brake issue.



Those of us in NY, NJ, HI and CA have laws we need to know about in relation to the old ban which are still in effect today....So your buyer must either live in a State requiring Pre-ban AR15s or is un-informed on the laws.  In any case call EA to find out when the rifle was made, and if it was sold as a stripped lower or complete firearm.  Those facts will be useful only to a person in a current banned State.
