Your hammer spring is probably in upside down.

The pin closest to the rear of the lower is the takedown pin . . . ??

Probably the trigger pin walking out, and it would do that if the hammer spring was not installed correctly as the legs of the hammer spring should hold it in place.  Who put the lower together?

Closest to the rear - trigger pin?  If it started to walk, check the other side. If one side is flush and the other is sticking out a little, you have a broken pin - but most of the time, it's the hammer pin that breaks. If you have a broken pin, you can get a little flexing in the fire control group that may be causing your misfires.

Is it a plum crazy lower by chance? Their FCG is a little different, mine was assembled wrong and the pin would back out.

after a closer exam, one of the legs on the hammer spring was bent, Not real bad. i think it wasnt putting enough preasure on the pin. Note* that was the side where the trigger pin was coming out

This happens.  Easy enough to fix.  Should be up and cool running by now.
