If I build a pistol from a reciever thats never been assembled as a Rifle can the pistol have an overall length greater than 26 inches?

Yes.

The only concern is if the dealer mistakenly listed the receiver as a rifle instead of other. You  can make a pistol any length you'd like.

Only reason to build a pistol over 26" would be to add a VFG legally.

The reason I asked the question is that as I add up the lengths of a buffer (7.5"), the reciever (7.75") and the then barrel I'm getting over 26 unless I use a 7.5 inch barrel.  Right now I have a barrel that I'm planning to shorten but I'd like to minimize the labor involved.  I'd also like to avoid using a 7.5 inch barrel if I can.  

I have an extra M4 barrel I can easily shorten and re-thread and I'd prefer to use that.

The answers you have gotten so far are correct as those gentlemen usually are.  But they refer to federal law.  Be sure you also meet any requirements of state/municipal law as well.  Some states have "maximum" barrel lengths and/or OAL for pistols, etc.

True, OP is in Texas, and in most states, the OAL max for pistols usually only applies to CCW's.

My interpretation of the documentation from ATF was as you guys have explained it but I wanted to be sure - I see a lot of pics in some threads that seem to show 26+in pistols and I wasn't sure if thats what I was seeing or if they were being achieved in some way I didn't understand.

You need a 11" barrel to get to 26"LOA unless you use one of those useless short REs (buffer tube).

Carbine RE with a 10.5" barrel gets you to 25.75". You can pin and weld the muzzle device to get you over.



You can't just measure the individual parts and add them up to get an accurate OAL.
