Not a gray area at all. Once a rifle always a rifle. You put a short barrel on that lower you are now in possession of SBR regardless of what you build it into. Get a SBR tax stamp and you can put any length barrel you want on it as long as your state allows you to possess a SBR.

If you want to build a pistol get a virgin lower that has never been assembled.
