Here is a question for you Class 3 guys. If you fill out a form to get a tax stamp for a Short Barrel Rifle do you have to buy a gun new as a SBR or can you register a lower that you have and once approved can you put a short barrel on it. I am getting mixed information..... Any help would be apreciated...... Thanks

You can register a lower you already have, just don't cut down the barrel or install a barrel < 16" until you've got the tax stamp in hand.

you can register a lower you already have. There are lots restrictions though. once you register it you must...notify the BATF before crossing state lines....request approval before selling an SBR registered receiver...even if your heirs inherit it, they don't pay the $200 tax but they must have BATF approval before legally possesing it.  And don;t forget you need local LE signoff, of county or state SA or AG. A Royal pain in the butt...thinking about doing it myself too.

Thanks for the info, I do not think that I would have a problem gettting aproval from our local LE agency since I was a police officer before budget cuts hit. Anyway I have a last thing. I want to register my bushmaster lower, Do I have to resubmit a new tax stamp when I change uppers? Thanks guys.....

Nope,...The reg'd part is the lower.          Remember a postban lower is still a postban lower even if it is a SBR, Well at least for another 139 days........UDOG

When you register it state its length as "less than 16 inches", and state the caliber as ".223, 9mm, .22" etc. That way you can use any length upper on it from 7" (yeah, yeah, don't all you guys get started on that now) up to a real 14.5" M4 barrel. Similarly, list every caliber you might use, that way you can run a 9mm upper on it, for example.
