I have a new lower I got stipped and the transfer papers did not list it as a pistol or rifle and I asked the FFL if I could build a pistol or a rifle and he said 'sure'. Now this is were I have gotten so many answers I don't know what to believe any more. the way I understand it is: If I DO NOT put a stock, adjustable or fixed, on the lower then I can put a short barrel on it, BUT if I put on a stock fixed or adjustable my barrel has to be 16" or longer. Then there is some rule about sort barrel with a pistol stock can NOT have a vertical front grip... and on some sites selling shorter then 16" uppers make no mention of NFA laws. Hoping to get this cleared up. Building a 11.5" even without a stock sounds like fun (Loud, but fun).  
Thanks for any help! last thing I need it trouble with the LEOs.

You're on the money with your own answers. Any barrel with a "stock"  just has to have a pinned/welded muzzle device to bring it to 16".

14.5" + 1.5" = 16.... 12.5"+ 3.5" = 16", etc. Actually a little longer than 1.5", taking into account for the threads.

Without a tax stamp your 11.5" and a pistol buffer tube is legal. (no VFG)  Add a stock = add a stamp.

That VFG turns a pistol, (one hand grip) into a rifle, (two hand grip), which is now an evil sbr.


Now on the Magpul Angled Fore Grip, someone else will have to chime in on the legality of that one.

i am local and your g2g with the stripped lower being a pistol. as far as the vfg its a no-go but the magpul afg is good unless things have changed recently. anything under 16 has to be pistol but over can have a stock. something to watch for is the overall length of the pistol you are making when it hits a certain length it is considered a firearm and not a pistol or a rifle. ill try and find  the link

here it is anything over 26 in and not concealed on your person can have a vfg. per the date on the letter if things have not changed

Actually, I believe it turns it into a AOW, not a SBR.

It's not the stock alone that determines if it can be built into a pistol, it a stock and a barrel. Any lower that has never been barreled as a rifle can be built into a pistol.
What this means is that at some time the lower had to have both a stock and a barrel on it at the same time to disqualify it as a potential pistol lower.
A lower with a stock and a barrel 16" or greater is a legal rifle. This is a title 1 firearm.
A lower with a stock and a barrel less then 16" is a SBR (short barreled rifle) and is only legal with an approved form 1 or from 4 in hand, provided it is legal in your state. This is a title 2 firearm.
A lower built as a pistol can have any length barrel you want provided it meets your state definition of a pistol. Michigan as an example says a pistol is under 30" overall. Tennessee says a pistol is a 12" or shorter barrel. Check your state law to determine the status of your build. This is a title 1 firearm.
A pistol with a Over All Length of less then 26" can have a magpul AFG (angled fore grip) or a hand stop but not a VFG (vertical fore grip). This is a title 1 firearm.
A pistol with a OAL of less then 26" with a VFG is a AOW (any other weapon) and is legal only with an approved form 1 or 4 in hand. This again depending on your state law. This is a title 2 firearm.
A pistol with a OAL of 26" or greater may have a VFG, however when the VFG it installed it is no longer a classified a pistol. This is a title 1 firearm.
A pistol with a OAL of 26" or greater with a VFG has no official sub classification (pistol, rifle,...) and is simply a title 1 firearm, provided it is not concealed. If it is actually concealed on your person it can be classified as a AOW.
A pistol may be converted to any other title 1 firearm and returned back to it's original pistol configuration anytime.

Title 2 firearm = NFA firearm, i.e. SBR, SBS, AOW, DD, machinegun. Must have form 1 (build) or form 4 (transfer) approved and pay your tax!


No form1 for machineguns.  Private citizens, non FFL 03 types, can no longer build new machineguns
