I am about to order a lower, When it gets sent to my local FFL, Do I just do the paperwork and take it home like a rifle or do I need to wait 2 days to pick it up like a handgun?

It depends on how the company you are buying the lower lists it on their website. If its listed as a pistol lower its 48 hour waiting period. If its a rifle/long gun lower then you can take it home as soon as they finish calling it in. Although it can be built as a pistol if you use a rifle lower you will need to get a NFA stamp because it will be considered a SBR (Short Barrel Rifle). |

No. It is not a rifle if it has not been barreled with a rifled barrel and equipped with a stock. It should transfer as "other", and there's a checkbox for this designation on the current 4473 forms. An FFL who transfers a lower as a "long gun" instead of "other" has perjured themselves filling out the federal paperwork. Specific state-by-state rules may exist for whether a waiting period only applies to "handguns" (which a lower alone is not) or also applies to firearms classified as "other" |

While the lower is classified as "other" on the 4473 rules still apply at the federal level and some states. One of those rules are that a FFL can not transfer an "other" to someone under 21, like a pistol/handgun. So, depending on your state, there may be a waiting period. I would call your FFL and ask them.
According to the ATF there is no such thing as a pistol lower until it is made into a functioning pistol. As in, you buy a complete AR pistol from a GS. Some states or localities have their own set of rules that superceed federal rules. |
