I was looking at the silencers at www.advanced-armament.com and was wondering how well they realy work. I was also wondering about the legalities of silencers. According to that web site i can own them in wisconsin

a silencer is the same as owning a full auto m16. you'll need approval from the police chief in your area or his deligit or state police chief. thats the hardest part, convincing good ole' sheriff bill that i "need" this silencer. from there its paper work and paying the batf tax which i believe is still 200. after the dealer submits the paperwork, 3 to 12 months later you get to pick up your toy. oh...you must also submit paper work that the title 2 item is also stored in a "secure" location. there are a couple of good sites on the web about the rules of doing this and a grain of salt is required to everything you hear. i had a argument with a person at the local firearms place just yesterday. the person was explaining to a customer that you need a class 3 license to own a full auto weapon / silencer ect.... i told this person there is no "license" and the argument ensued. you have the tax paper.....and that is you "allowed to have" document. carry it with you always when gun is in your possesion. don't go anywhere with it except to firing range. and never...never cross state lines without batf approval |

I just bought two suppressors from advanced-armament, and I can tell you what it took for me. First I had the dealer order the suppressors and paid for them. I waited for them to be delivered to the dealer. Upon arrival, the dealer fills out the paperwork. I then got passport photos which are attached to the paperwork. I then got fingerprinted at the sheriff's office. I then had the chief law enforcement officer where I live to sign the form. A $200 tax is included for each suppressor. The whole package is then submitted to BATF. I am still waiting on the tax stamp and can't take the guns home until I get the stamp back. I went through the same proceedure to buy a machine gun. If your CLEO is willing to sign the form, there is really nothing to it. Before you go any further you should find that out. The dealer should know if the local CLEO will sign the form. If the dealer is not located in the same town you live in, then call the office of the chief of police or the county sheriff. As to how well they work, I have never fired a suppressor in something like an AR15. I have fired a couple .22s and an HK MP5 that was suppressed. They worked great. The .22 was extremly quiet, you can hear the bullet strike the target and the brass hitting the ground. |

Quoted: ... oh...you must also submit paper work that the title 2 item is also stored in a "secure" location. There is no such animal. Although it is in your best interest to store in a secure location, there is no requirement for private individuals. A good website to checkout www.titleii.com |

...and silencers and AOWs may travel willy nilly across state lines as long as they are legal items in your destination state. I was under the impression that NFA items cannot cross a state boundary unless accompanied by a form 5, IIRC. This is a form sent to the BATF that informs them that the item will be outside the registered state on a temporary basis. |

Ahhhh he did not do so bad. He only got the storage issue and transport issues wrong. Not so bad compared to some of the incorrect spew you hear from gun show wanna bees. I never understand why when people have questions about something they ask people who have never done that something. Makes more sense to me that if you have questions about trap shooting you ask a trap shooter, questions about NFA items ask someone who does that, not rely upon what the friend of a friend of a guy who attended a gun show once heard his brother say. But I hear it all the time. I also get people at gun shows try and argue with me that I can not possess/sell/display the weapons I am at gun shows because they are illegal. Or the trap shooter types who are just plain disgusted that these items can be owned. You know if you are afraid of guns then maybe a gun show is not the place you should go. Rant Mode off. |

And just like Old Tiger. He knows enough to know that he/most people can not possess NFA items in his state of Iowa. He probably does not know that non shotgun based AOWs are ok in Iowa, and that if you are in the secret handshake club of the government with special pemit as a licensed contractor of the state to thin the states deer population you may possess silencers and hunt with them. He is not even alowed to hunt deer with a rifle but those in secret handshake club those laws do not apply to them. And they still vote Democrat year after year after year. Rant mode off again. |

Southern Raider one small new whoopsie in yor last post. The form 5 is for a tax free transfer typically to/or from a government agency. For a long time the ATF was requiring a form 5 to be filed each way to/from a gunsmith for temporary transfer to a gunsmith for repair of an NFA item, will ATF finally realized that this was what they want and not based in law, so now NFA items travel in/back for repair and refinish willy nilly without regards for ATF prior approval. The form you were thinking of is the 5320.20 which is notification of transport of you NFA item across state lines. While ATF will accept and approve the forms for transport up to a calander year at a time for all NFA items it is only required for Short Rifles, Short Shotguns, Destructive Devices, and Machineguns, not for AOWs or Silencers. When traveling it would not hurt to have a 5320.20 approved from the ATF allowing transport incase you get stopped in a place like Iowa because chances are the cop in Iowa is not going to know the laws at all and the more pieces of Federal Paper you can throw at them the better. If you want to learn it all you can read http://www-2.cs.cmu.edu/afs/cs.cmu.edu/user/wbardwel/public/nfalist/nfa_faq.txt |
