ATF has taken the position rather recently that sending a C3 to a smith requires a 5320.20 if the item is going out of the state. If the smith is in the same state as your residence/its residence then it wouldn't require a 5320.20. The NFA Repair letter process was just talked about in one of the recent SAR Magazines. If you are into C3 weapons I recommend getting a subscription. One other thing you need to write up a NFA repair letter explaining why the gun is going, for what services and the estimated time for work, to properly show intent to not execute a "illegal" transfer. Usually you can put the 5320.20 in with the paperwork inside the box. I haven't every directly provided that type of information to the shipper. Since the 5320.20 is between you/smith and the ATF. But I could be mistaken, things change on what seems like a continual basis... :) Back in the day I used to have to do Form 5's for my repairs, now you can just do the repair letter process/5320.20 still a much simpler way than the Form 5. Since you don't mention type of work, you could look around and see if there is a C3 local that could do the work then you could bring it to them and not have them do the work while you wait. I get my HK work done by one of the better smiths since he is 30mins from my office. |

I'm just sending it off (out of state) for engraving. The instructions on the Form 1 states "5320.20 shall be furnished to the carrier and shall be in the
possession of the carrier for the duration of the transportation." This being a stripped SBS receiver, I would see no need for me to physically give a copy of it to the shipper. I'm assuming I can just put a copy of it on a "Packing Slip Enclosed" envelope and slap it on the side of the box. |

This is actually a really good question. I KNOW you don't have to file anything before it's approved, but if you wait until after the Form 1's approved, do you have to file 5320.20 and wait for approval on that before you send it out for engraving? Also, is it best to not use the firearm until you get it back from the engraver, AFTER getting an approved 5320.20 back because it's not engraved? |
