Very peculiar situation, but you would be vulnerable to an unregistered SBR possession charge through CP. The launcher is not a firearm, but the presence of the sub-caliber device and the shoulder stock creates CP for a short-barrel rifle. The shoulder stock precludes an AOW. Without the shoulder stock present, it's a firearm but not an NFA one. Even if mounted on a rifle, the rifle's shoulder stock is not considered a shoulder stock for the launcher. |

Yes it is constructive possession
37mm with anti-personel is considered a DD. It does not matter what sub-cal adapter you use. Flare, smoke, and gas is all you can use with it unless you register it as DD. I wouldnt waste my time/money even buying the 22cal insert unless you had a 26.5mm and i still wouldnt have it at the same location with the 37mm to 26.5mm adapter Save some money and get your 37mm registered. It will be less headaches then trying to ride in the dark grey area of the ATF rule book. |

You are surely correct that it's a firearm, but unless some kind of pistol grip is attached to the launcher (and I've never seen one), I don't see how it's capable of being fired with one hand, which means it isn't a pistol, and it doesn't seem to be a rifle, not even an SBR, so presumably it's AOW? |
| Any adapter that makes your flare launcher "capable of use as a weapon of offensive or defensive combat" would require registration of the launcher as a DD first. Regardless of caliber of the insert. If there are AP munitions available for that adapter, and you have the launcher and adapter, your launcher better be properly registered. GROG |
