I have a couple dumb questions.
If I had a MP5k SBR with a vertical grip, would it be illegal to fire it without the stock (created an illegal AOW?) Even storing it without the stock attached? What about something like a scorpion Evo Carbine. Without the stock on is it an illegally manufactured pistol (or does it not matter as the manufacturer intended it to be a rifle?) It would be less than 26" long. What if it has a vertical grip? Back to the intent question. Why are OEM ar-15's (sold with out furniture) transferred as a rifle as opposed to a pistol If I were to build an ar15 from a virgin receiver with a 16 inch barrel and carbine receiver extension but no stock it would be a pistol. Is that based on intent? Mostly these are curiosity questions and I will not be writing the ATF any letters. |
| And as to the Colt OEM question, it is because Colt classifies and markets them as Rifles. So they are said to be "designed to be fired from the shoulder" because the manufacturer says they are, even though they lack a stock, they market it as designed to have one and be shouldered. |
