Awhile back, I made a batch of Major League Zombie Killer patches (MLZK). Sales were good. I eventually sold what I had left over to Valkyrie Tactical.  A few minutes ago, a searched for MLZK on Google out of boredom, and low and behold, I found my patches being made by someone else! By "Americans" no less!

My patches:

Stolen design patches:

Here's the douchbags selling my design

Your work may be copyrighted (by you), but I don't know the specifics.  If you want to do something about the thieves, you should look into it.

I hate thieves.

I too would be seriously annoyed if that's your original artwork being lifted.

What's amazing is I don't think they even "get it". It's not major league anything with out the two color background.

Sorry to see that.

Was it your "Original Idea" to use it on the red and blue background or is that an idea you borrowed from major league sports???

MSM has been using the Major League sports themed patches relating to AR's and the military theme for quite some time with the "Major League Sniper", "Major League Infidel", and "Major League Doorkicker" patches. So the OP should not really be given any shit for using that design.

You should make a patch that says "MLDS" and see if they get it...Major League Design Stealing

Just call the guy and bitch him out.  Tell him to get it off the site right away or you will take him to court in your state and he will have to fly there to attend.  I am sure he will comply or else sue him in small claims court.

If your patch is indeed your original creation, then it is protected in the USA by copyright law.
Contact a lawyer and pay a small fee for him to send a cease and desist letter.   Or you can google "cease and desist" and cobble your own.
Send it registered mail.   Also register your artwork with the U.S. Copyright office.   This makes you eligible to receive statutory damages.

Good Luck.
I am not a lawyer, and this does not constitute legal advise.   I did however take Copyright law in college.

I just find it a bit humorous that the whole theme of his patch was lifted straight from major league sports (MLB, NBA), now he is the one complaining because someone took what he made and is selling it as thier own.  He may have done the zombie skull artwork, but the instantly recognizable colors, and appearance are definitely not his.  Not to mention the "Major League" reference.

The OP's use of the MLB motif is a parody, not a copy. The item on kamel-tow.com is the result of deliberate copying. There's a difference, and it's not a subtle one.

"Kamel Tow",

To read through your "company's" bio saddens me to see the blatant theft of another Americans work. I also am finding myself curious of how much of your other materials are stolen property? To see the MLZK Patch on your site without the original creators concent is very disturbing. Have you or your company no morals?

Sincerly,
A customer that will never be

I have a copyright pending. I can also give proof that I am the original creator from such forum boards such as ARFCOM (though my original thread got deleted...)

Parody or not, if major league baseball gets wind of these you and the msm kid are going to get cease and desist letters from some angry new york lawyers. I know a guy who got threatened with a lawsuit over something similar.

I seriously doubt it.  It's been done plenty of times by a bunch of other vendors of all kinds of goods.....if those people havent gotten letters I doubt the op will.  Not only that but it's perfectly legal to do parodies of companies logos.  It happens ALL the time.

I guess he listened. I didn't get an email back, but he did take those patches off his website, but the pictures still come up in a goggle search.

They will probably come up in a search for a long time.  They will be on Archive.org's Wayback Machine forever!!   You can actually look at Archive.org and see the exact day he posted those to his website if you decide to press charges.   Then you can ask for all his sales records from that date on to get your money that's due to you.

Edit:  Looks like he was sneaky and prevented his website from being crawled.   However the first time his site was up and running was May 12, 2010.
