Just got 8 disapprovals for SBRs. 1 had no reason given, 7 had the BS copy pasted "silencer" message at the bottom of this post (to keep this readable). Somebody goofed. The big trouble is, I'm in Virginia. These took just over 2 months to come back, they're PMFs I haven't made yet so there's no pictures to submit. I need those serial numbers and I don't have another 2 months to wait before the July 1 ban goes into effect and I'm SOL on them. I've got another 5 in the pipe that may or may not come back the same way. I reached out to "ask the experts" and [email protected], I also reached out to GOA who sent me some lawyers to contact if it comes to it. I've resubmitted these 8, plus the extra pending 5, with a new serial number range and the description message "HOMEMADE FIREARM, RECEIVER NOT YET MADE, FIREARM WILL BE ENGRAVED TO COMPLY WITH MARKING REQUIREMENTS IN 27 CFR 479.102." I'm thinking that'll hedge me in case ATF wants me to resubmit them exactly as I did. Maybe I get double stamps, maybe I get nothing, we'll see. Again, these are all SBR applications: "AS PART OF THE APPLICATION PROCESS, ATF MUST CONFIRM THE MAKING OR POSSESSION OF A FIREARM WOULD NOT PLACE THE APPLICANT IN VIOLATION OF LAW. THE INFORMATION YOU PROVIDED WAS INSUFFICIENT IN MAKING A DETERMINATION. PLEASE RESUBMIT YOUR APPLICATION AND INCLUDE AT LEAST TWO OF THE FOLLOWING: -PICTURES OF THE PARTS THAT YOU WILL USE TO MAKE THE SILENCER (THE PICTURES SHOULD BE CLEAR AND ALLOW THE IDENTIFICATION OF THE PARTS PHOTOGRAPHED), -A DESCRIPTION OF THE PROCESSES YOU WILL USE TO ASSEMBLE OR FABRICATE THE SILENCER, -THE PRODUCT, MODEL IF ANY, OF EACH DEVICE AND/OR PART THAT YOU WILL USE TO MAKE THE SILENCER, AND -THE SOURCE FROM WHICH THE PARTS WERE OBTAINED, I.E., THE NAME OF THE STORE, WEBSITE, ETC." |

Are you sure what you’re trying to do will still be legal? Most AWBs have a “nor can a weapon of a banned configuration be made/assembled after the fact” clause. You could be creating a paper trail that hangs you rather than circumventing a future law. Just asking as the ATF’s response seems to imply that they (also) don’t know if what you are trying to do is/will be legal. |

You're correct that they have to be made before July 1 which is no big deal, I'm not trying to get stamps for future builds to be sneaky or anything like that. I'm trying to get stamps to get legit serial numbers in a way that complies with the new PMF serialization law. If I miss this window, then it gets trickier; I'll have a year to find an FFL to do it (who's going to accept that liability?) or hope that there's a clarification of "pursuant to the laws of any state" that allows personally serialized PMFs to continue to be legal. |

Wild stuff... No update on my emails etc. to them on the previous batch of disapproved stamps, but I got an email this morning asking for some design details on a MAC10 and a NYLAUG (printed receivers for both) - those were approved after I sent some info and some CAD pictures. A 3011 (printed 1911 lower) approved with no follow up at all. Also got approved for model "7.62 CAL" with no details or followup, as well as model "9MM" with no details or followup. It doesn't get much vague-er than those, so I was sure they'd be disapproved... Vague AOWs "ZIPGUN," "ZIPPO 22," and "PENGUN" were disapproved. Seems some inspectors want details and some don't, there's no real rhyme or reason to it. |

I resubmitted this block of them on the 14th of last month, just got them back approved yesterday and today. For descriptions I updated to: "INTEND TO 3D PRINT LOWER RECEIVER, SEMI AUTO ONLY WITH DENIALS, MARKINGS & SERIAL ON PERMANENTLY EMBEDDED STEEL PLATE" or "INTEND TO MACHINE 80% LOWER RECEIVER, SEMI AUTO ONLY, MARKINGS & SERIAL TO BE ENGRAVED IN COMPLIANCE W/ 27 CFR 479.102" It's bizarre to me, because that doesn't actually give them any more information regarding the legality of the final configuration, but if that's the hoop they want me to jump through then whatever. In any case I'm sitting on a pile of stamps! |
