Just noticed that on this site: http://www.autoweapons.com/pagelinks/statelist.html It says MS requires a permit. I can't find anything on the dept of public safety website. Can any1 tell me or point me in the direction of what this entails? I will be moving there late this summer w/a SBR. |

Have several SBRs, a couple of Suppressors and an MG and no permit required that I know of. Local LEO did all my transfers (Dep Chief is Class III) except SBR (and they signed off on first (Sheriff) before I found Trust Route Never heard of a "state permit". At ranges no-one has ever asked for paper either - LEO's usually just want to play with my "toys" and find out how they can get their own. I give them all the details and several have shown up later with their own SBRs and suppressors. Very NFA friendly state. YMMV, FH |

The only extra paperwork to do with any nfa in ms is registering the suppressor with the state which the dealer in most cases does. ...and yes we do have a damn friendly nfa state:D |

I don't think this is true ... as of last week Despite the fact I live in NE, I am actually a MS resident (MS DL, CCW, Address, & Taxes). I have a suppressor on a NE Form 4. I called DPS numerous times as well as a MS SOT. Both sources told me that MS does not require the registration of any firearm or silencer. ~rj ps.: If someone knows for fact that I was told wrong, i.e., has a recent piece of paper from the state w/a suppressor serial number on it, please let me know who I really need to talk to! |
MISSISSIPPI CODE OF 1972 As Amended SEC. 97-37-31. Silencers on firearms; armor piercing ammunition; manufacture, sale, possession or use unlawful. It shall be unlawful for any person, persons, corporation or manufacturing establishment, not duly authorized under federal law, to make, manufacture, sell or possess any instrument or device which, if used on firearms of any kind, will arrest or muffle * * * the report of said firearm when shot or fired or armor piercing ammunition as defined in federal law. * * * Any person * * * violating this section shall be guilty of a misdemeanor and, upon conviction, shall be fined * * * not more than Five Hundred Dollars ($500.00), or imprisoned in the penitentiary not * * * more than thirty (30) days, or both. All such instruments or devices shall be registered with the Department of Public Safety and any law enforcement agency in possession of such instruments or devices shall submit an annual inventory of such instruments and devices to the Department of Public Safety. The Commissioner of Public Safety shall document the information required by this section. |

I read that, multiple times ... Either nobody in MS owns a silencer and DPS didn't know what to do with my request, or that clause was updated/repealed/re-interpreted, or some other agency deals with it; b/c when I called MS Dept. of Public Safety, they told me that they do not register silencers. Who (in MS) has one, & who did you talk to, name & phone number please, and what paperwork was done. I will try to call DPS again today, and see if I can get a different answer ... trying not to break the law regards, ~rj |

Class III is local Dep Chief of Police and all he did was a 4473 just like a standard transfer of a firearm and I think that is the "local registration" of the suppressor. We did talk a little about using the 4473 but he shrugged and said he did it all the time so I figure that fills the square. Never had any problems and shoot w/lots of LEO and they are always tinkering with their stuff at the gun shop same time I'm fiddling with mine and we are always comparing so someone would have said "WHOA - you gotta let me see your STATE PERMIT for that XYZ123 Godzilla Suppressor" or something like that. Never has happened. Great state - main problem is everyone wants to shoot my toys - need to get my FFL/SOT and start making some money on this addiction!!! FH |

In my quest for a definitive answer on this, I think I went too far. Once again, I called the DPS, they said uhh, hold please The next guy who answered the phone was from the MS Crime Lab. He said illegal for an individual to own. period. -- judges ... buzz, wrong answer; try again. He referred my to the Jackson ATF field office ... "I cannot comment on state law, look it up ATF Pub 5300.5." Yep, the wording above is the current version of MS Code 97-37-31. At this point, I'm back where this whole thing started. The ATF agent suggested calling the MS Attorney General, so I did. But the number in the ATF Pub was for the consumer affairs branch of the MS Atty. Gen., I asked the AG the question, and she said she would forward it to the proper branch, and they would call me back, probably tomorrow. As I hung up the phone, I thought OH $#!+. Now I've got the AG looking into this, and the best-case outcome for this scenario is that the State will begin to actually to enforce this (b/c the apparently don't, seeing how nobody in Jackson has an f'n clue). Worst-case outcome, the AG goes "OH $#!+, silencers are legal here!" and then all of a sudden, they're not. Sorry guys, I guess sometimes things are better left alone. ~rj |
