I am currently building my first AR and am interested in installing a short barrel (11.5). I don't want to get into any trouble with the feds so I want to do this right. Can I purchase the upper with the short barrel prior to applying for the stamp and just have to wait for it before putting it on my lower receiver? OR do I have to have the stamp to purchase the upper/barrel?

I have been looking at the ATF website and am getting a headache. What form do I need to apply for a short barrel permit for a rifle and how do I get it.

You'll get better answers, many of them from tacked threads, if you go to the "armory" community and read the NFA forums.

Sorry killer, this is a not a good example. You can just as easily get oscar mike to the hootch of your family or friend to illegally play with your new toy while you wait as you can while the thing is sitting in your hootch. Granted, you may have friends & family that live a clip down the hard ball, but I still vote against it if you have the means & the the intent. If the ATF really wanted to prosecute you for constuctive possession then this is a good an example as any. They have gotten their way on lessor prosecutions. Wait for your stamp to be approved & in your paws. All that has to be proven is that you ordered something that is illegal to own until an approved stamp comes back & sent it to an associate's home or office. Apparently many folks here do this & I don't understand why one would want to toy with their freedom both phyisically & financially. If you don't die while waiting a few weeks or a couple of months waiting on your paperwork then you won't die waiting on an upper to arrive after the stamp process.

Edit: And I know vendors will sell you an upper w/out proof a stamp but head shops sell dope paraphernalia legally & Auto Zone sells opague license plate covers that you know you aren't allowed to have on your plate. Waiting on your stamp w/out a pistol lower is the right thing to do.

Or you can just buy an AR15 PISTOL lower, and do the NFA stamp to that, Why? because you can put your 11" assembly on it AND shoot it while waiting for permission to install a stock.

this is one of those guilty before proven innocent topics we gun owners hate.  if you have a nfa upper in the same house as a non registered sbr or pistol lower, the ATF wil arrest you because they can "prove" intent.  so basically no, dont buy it until you get the stamp.  sucks, i know

Don't do it.  if you can readily affix it to an unregistered lower...they could have your A$%!
