Aside from local laws prohibiting, in what situation could you buy a firearm but not an NFA item? What more does the ATF look at that a NICS check doesn't cover?

NFA background check matches your fingerprints to what they currently have on file in the FBI database.

By a rare chance this is the first time you were ever finger printed and submitted a Form 1 or Form 4, your prints will be added to the FBI system.

Most usually end up already having their prints in the system from back ground checks for employment, government clearances, conceal carry permit, etc.....

Being over 18 but under 21 and trying to buy from a dealer.  You could buy a rifle from the dealer but not a SBR from the dealer.

Federally speaking, there isn't much of a difference as far as what would get you a denial between NICS and the FBI background check

But when the NFA was created there was no NICS system, if there was it likely would have been implemented.

To implement NICS now instead of the FBI check, would likely take an act of congress, so not likely to ever happen
