I'm planning on starting my 5320.20s soon since it takes me awhile. I have to fill out 5 of them per State. I have always filled them out for each State that I travel through, just incase my wife ever decides to stay the night in one while traveling. When is the correct time to fill one out for a State? If Im traveling through it while traveling to a final destination? What about a trip where we are aiming to hit multiple States without a single destination? |

Only required for destination states. I don't do them for ones I'm passing through on the way, even if you stop for gas, food, or an overnight rest for longer trips. Now if you are actually stopping in multiple states for more than the above, then I'd probably file for any state with an extended layover, especially if there's some purpose to the stop there outside of just a rest stop from the drive. |

You only need a 5320.20 for your destination. And remember that you are exempt from 5320.20 requirements for: a. AOWs; b. Suppressors; c. Any C&R NFA if you have a C&R in the same ownership name. (Example: If you have a C&R on your personal name and a C&R gun in your personal name, no 5320.20 needed. If you have a C&R in your personal name and a gun in a Trust or Corp, you’ll still need a 5320.20.) Stopping for fuel, food, bathroom breaks, hotels overnight, and bonafide emergencies doesn’t require a 5320.20. I agree that you should do a 5320.20 if you’ll be stopped for more than a night. You absolutely need to do a 5320.20 if the gun will come out to play or even just get displayed somewhere, even if you’re not stopping for the night. Moving the gun from your trunk to your hotel room for safekeeping is not coming out to play, but it should stay in its case and not be shown off. Personally, I’m pretty paranoid. If I’m going to be stopping for an overnight, I do a 5320.20 just in case some local/county/state cop has a stick up their rear. With eforms, it’s just a few extra minutes. I figure that’s worth the security blanket the approved form provides. YMMV. Avoid stopping in closed states whenever possible. I know what FOPA says, but I also know what my bank account has for legal expenses. And frankly, I’d rather not spend a cent in most closed states anyway. If you must stop, strictly limit your time. I recommend planning ahead to avoid overnights in closed states. |
