OK, a couple recent threads have me confused.
I looked in the FAQ here and I've checked the ATF SBR FAQ and I can't settle this to my satisfaction. If I build a SBR on a Form 4 and specify a barrel length, am I in violation of the regs if I then change to an upper with a different barrel length? TIA. |

Firstly, you use a Form 1 to make an SBR. It's an "Application to Make and Register" a firearm. Form 4s transfer previously registered NFA items.
As for using other uppers, that's perfectly fine. ATF requests (but it isn't legally required) that you inform them if you make a permanent change to what's shown on the Form. |

Your F4 is used for suppressors, MGs, or factory SBRs. It also entails no engraving. If purchasing, say, a Colt 6933 from a Class 3 dealer, it would happen on the Form 4. If you have a lower and want to register it to make a Short Barreled Rifle, use the Form 1 available here
You also need 1 copy of the Certificate of Compliance $200 check made to Department of The Justice 2 copies F1––-Front and Back Trust (if applicable) Cert of Comp And patience....... You may have as many sub 16" uppers as you want for your registered SBR lower. I had 3 at one point, currently 2. Plans for more, if I see tokarev ammo every becoming available agin

Yep, my bad on the Form 1 vs Form 4 budiness. It's been a while.
I guess what's hanging me up is thinking that if you've specified a a barrel length, say 7", on the Form 1 and you just slap a 10" upper on it, you're in violation insofar as you now have a SBR with a barrel length that is not in agreement with what was registered with ATF. Hence, you can't swap uppers at will but have to stick with whatever barrel length you registered in the first place. Or maybe I'm overthinking this? I'm asking because I built a 7" upper several years ago. While lots of fun, I'd like to get an upper with a little longer barrel. |
