I am interested in possibly getting a sbr.  I am looking at the Noveske 7.5 in 6.8. I noticed that the price for the upper is half the price of the complete package. If I buy a regular lower, can I then buy the upper and pay the tax and register it that way or do you have to register the lower and upper if bought separately , thus paying the tax twice.  Id like to figure out the cheapest way of getting a totally compliant sbr.  Thanks

Just so you have it straight.

DO NOT HAVE AN SBR UPPER AND A COMPLETE LOWER IN THE SAME DWELLING WITHOUT A PAID TAX STAMP!

Get the lower.
Register the lower (and have it engraved)
AFTER you get the tax stamp back, buy the upper.

never had an issue... but have it engraved before filing your form 1... if it is lower is lost in the mail or the engraver screws it up... saves you from havin to refile... after you have it engraved and back in your possesion send in your forms. better safe than sorry

There are no laws prohibiting putting any length of barrel on an SBR.  Once registered you can configure that gun however you want so long as you don't give it a happy switch.  If you change the length from what is registered permanently, the ATF instructs that you notify them.

I am not a lawyer and this is not legal advice.


I think a way to get around this is to put a wide range of length of barrel and overall length.

Like 5"-28" BBL and 10"-55" OAL.

ATF may have a problem with this now, but that's what alot of people did.

These days they seem to want a specific length but it really depends on who processes your paperwork.  Some examiners are more strict than others.

Are you building or buying?

If you're building you need to buy the lower, fill out the form 1, wait for the tax stamp, get the lowered engraved, then you can buy the upper (don't need to register that) and you should be GTG.

(This is a real basic summary...but you get the idea)

Thanks that link helps out. I would probably build if it is the cheaper way to go. I am an AR rook, am I correct to assume that a sbr upper will work with any complete lower?

Many examiners reject papers for that now, so I don't usually bother to advise people to do it.

Current policy is ONE length of barrel and ONE overall length.  Anything esle gets rejected.  Keep that upper and have as many spares as you like of any length or caliber.

Depends on who is knocking at your door.  It still could be "constructive intent".  Best not to have the pistol disassembled.
