I live in Missouri. Back in the day, you needed an FFL to own NFA items in MO. I got my C&R license to meet the requirement. My wife and I already had a trust, but the ATF would not issue an FFL to a trust, so the items are in my name as an individual. MO no longer requires the FFL. I own three NFA items, 1 SBR and 2 silencers. I was originally planning on having the items go to my son via transfer to heir (ATF Form 5) if anything happened to me. Now that the tax is $0, I was thinking about doing a trust and transferring all 3 to the trust. I want to make sure that I'm correct in what I want to do (and legal). A. Get a trust through Silencer Shop, National Gun Trust, etc. and pay the fee through whoever I use for the trust. B. Have only myself on the trust. C. Transfer the three items from myself as an individual to the trust for $0 x 3 (SBRs and silencers are still $0, right?). Submit fingerprints and photographs for myself. D. At a later date, add my wife and son to the trust without the fingerprints and photographs (they can all legally own the items, it just seems like an unnecessary hassle). Am I missing anything? Do I have anything wrong? Would it just be easier to have my son fill out the Form 5 when the time comes? |

Im doing that right now, OP. I have over a dozen Form4 pending transferring from Individual or Single Shot trusts to my new NFA Trust. Btw, National Gun Trust does sales ALL THE TIME. Over the Independence Day holiday I got one for $35. I did the eNotary as well and then started all my eforms submissions. |

Honestly thats why I kinda like the idea of individual trusts. Heck Ive considered moving them from my single trust to single shot trusts to make adding RPs much easier for later purchases. |
