Even though there are rule changes regarding trusts that are pending, I am still thinking of doing one.

I found a couple of online places that offer this service for a small fee, and I know Quicken WIll maker will do a trust.

My question is this..

If I go this route, is just a matter of buying the NFA item I want and sending the paperwork in for ATF approval?  Or does the ATF actually need to approve the formation of the trust itself even before I make a purchase.  I think the answer is no, but I just want to make sure.

The ATF doesn't approve your trust, they approve you to pay the $200 transfer tax per NFA item.

SBR that you "manufacture" from parts (factory SBR is more like suppressor):

1.  Form trust.
2.  Submit Form 1 to ATF (pay $200 tax).
3.  ATF approves application.
4.  Build SBR.

Suppressor:

1.  Form trust.
2.  Find a local (in state) FFL Class 2/3 SOT to buy suppressor through or to do the transfer if you purchase from the manufacturer or online.
3.  Manufacturer/vendor submits Form 3 to ATF to transfer the suppressor to your local dealer.
4.  ATF approves transfer and manufacturer ships to your dealer.
5.  Submit Form 4 to ATF.
6.  ATF approves application.
7.  Take possession of suppressor.
