I had two eform 1's disapproved today. What pisses me off is that they were both for Noveske stripped lowers. I had two Noveske stripped lowers Approved earlier this year, and used the saved information from those approvals, just changed the serial numbers on the two new applications. The reason for disapproval was given as "Model incorrect, should be N4 only". I put model as "MODEL N4", the same as my two previous approvals. All the examiners should be reviewing the applications in the same manner, and have a guide for approved and disapproved reasons. It seems like it goes by whatever the examiner feels like doing at the time. It would be nice if there was some consistency.

Resubmit and email Ted Clutter. Worst case you wait another month best case you get taken care of faster.

It could worse.  I have a form 3 coming in from another dealer, where the ATF somehow changed the serial number of the machine gun on accident.  Luckily I have the original amnesty papers that match the gun, or we'd be fucked.  Now, instead of literally hitting the back space button on a damn keyboard, it's going to take months to correct.........

And people want to give more power to government?????

Sorry, I'm venting on your post, but I can't help it.  I'm annoyed.

I have an approved Form 1 where the examiner (I assume) actually scribbled through 'Model' on my form.  Not a single line and initial, a complete scribble.

It was approved, but still its a bit strange.......

Yeah, all they want id the model number, not the word "model" in it.

They've got picky about calibers too, when I did mine I put "300 blk" for caliber, now you have to put "30" or "7.62".

I've had paper forms returned for similar corrections.

I think that they have certain metrics, and that a rejection/return for corrections counts as an action or a task done that day.

You'll need to resubmit and then email him with old and new control numbers, firearm serial, and trust name.   Mine got approved in 48 hours.

I had one kicked back 2 years ago for this:

AAC put "EVO-45"
SPT put "EVO 45"

Fucking dash cost me 5 weeks of fuckery.

Which is still an error. A previous approval with an error doesn't mean the next one won't be caught.

Ok that's fine. Is there a guide to exactly what you are supposed to fill out in each line of the application for every make, model and caliber gun you may form1? And does each examiner have a guide that says whats approved and what is not? I know for a fact that several other Noveske lowers were approved with the word "model" included. Who decides it is an error?

Technically, you as the maker assign the model number.  Just like you as the maker assign the serial number.

In the past, "new" model and serial numbers could be assigned when the Form 1 was submitted.  The fact that some other markings also exist on the gun is irrelevant.  ATF requests that you use the same number / model / etc.  But the text of the law does not seem to make that mandatory.  

You could say the Title II model on your N4 was "FRED".  Since you are making a new Title II firearm, you are the one that designates the model.  Not Noveske, and not ATF.

When I submitted my Form 1 on my Noveske lower, I just put AR-15 as the model.
Got approved no issue. But that was a paper Form 1 a few years ago...
Didn't even really think about it, as it's an AR-15 pattern gun. Maybe one day I'll submit a correction letter, but it doesn't really matter at this point in my mind...
And it's not the only lower I did that with...
