I have a SBR AR that I'd like to get a 300 Whisper upper for. I do have other complete AR rifles but no incomplete lowers. If I get a short 300 Whisper upper does that fall under "constructive intent"?

No such thing as constructive intent. You are thinking of constructive possession. I believe the prevailing thought is that as long as you don't have extra unregistered rifle lowers laying around, you are g2g.
