Will 01 FFLs be able to sell suppressors? From what I'm reading, cans would only need a 4473 to be transferred, so I would assume that opens them up to any 01 dealer. Disclaimer, I have not read the bill, just speculating from what I have read here of ARF

They can sell them now with an SOT  But yeah. They "should" be able to stock and sell them just like any handgun. The way I've read the bill, it amends the definition of firearm in the NFA to not include suppressors. But they are still defined as firearms in the GCA, so you'd still need a 4473 |

Paying the flat rate yearly Special Occupational Tax. If not an SOT, an 01FFL can pay $200 like everyone else. |

But to continue flogging the dead horse, OP, with some small exceptions, it's basically a pretty simple formula: • A FFL allows you to buy and sell most any firearm (Title 1 or Title 2) within and across state lines. • A SOT allows you to buy and sell most any firearm (Title 1 or Title 2) – tax-free – within and across state lines.* (*On the subject of Destructive Devices, it is admittedly wonky and currently "probably not". But for small quantities per year, usually ATF lets non 09/10/11 FFL's do the transfer, but they may have to pay the $200 transfer (Form 4). But sometimes if there's no DD dealers/mfgs in your state, maybe they let it slide. Flip-flopping has occurred over the years and administrations.) |
