That's a northern racer. When young they resemble copperheads. It's actually a common mistake.

ETA: On second glance, it does look much more like a brown snake. Harmless either way.

If you can imagine it a lot smaller, I believe they're livebearers. Biggest one I've ever caught was about 15 inches.
