The only reason dave wants felony charges on this guy is because him and his crew beat the ever living shit out of this guy.
There is a thing called proportionality in use of force laws. This guy had very serious injuries may be justified maybe not be. Depends on when his crew or whoever beat the shit outta him should have stopped once they had control. That could also be justified if he had a weapon. Reportly a knife. Personally i could careless. But i bet this dude could get a lawyer and sue claiming they used to much force in subduing him. A more serious charge might help mitigate a future lawsuit. I saw a picture of the dude after he was arrested. It looked like they broke his shoulder and arm. If the cops would have done that there would be riots already. |

As much as I hate that liberal DA and his bullshit policies, this wasn't a felony (in most states, I don't know for sure in California because I don't care enough to research the statute.) This was a battery that occurred with no weapon and no permanent injury resulting, simple battery is a misdemeanor. Him having a knife on him doesn't mean it was used in commission of the crime which would make it an aggravated battery
