Not surprised. The SCOTUS previously said that the feds can't withhold funds because of a reason unrelated to the purpose of the funds. Trump need to figure out a way to get 99% of what he wants with that limitation. He needs better quality lawyers writing up these EOs. He must have some flunky left over from Obama who knows how to write EOs that sound good to Trump but won't pass review. View Quote |

The judge was appointed to his position in 2002, and was a Republican representative in Illinois. The law is the law, and now it needs to be changed.

Trump is going to have to make an example of one of these cocksuckers.
When they start losing their cushy lifetime jobs (and pensions), maybe they'll quit being fucking outlaws themselves. |

Do our judges get to do this when they try to implement more gun control?

So funds cant be denied say's the dinosaur huh?
So if they want funds just give these sanctuary citys just $87.00 each and tell them to make it last Can the judge be fired/removed by the DOJ ? |
|
Very easily. There are two appellate courts and at least one of them will rule against this dumb@$$ district judge. There's the Circuit Court of Appeals that is over this bonehead. And if they are as stupid as the 9th Circus Court of Appeals, then the Supreme Court will straighten out things.

Doesn't the law allow fines for companies that hire undocumented workers? Just send audit teams all over the sanctuary cities inspecting employers' I9 forms and handing out massive fines. Raise some revenue for the deficit, drive out the illegally, make liberals scream: it's a win-win-win. Why does this not happen?

How the hell can a judge control what the DOJ does with its own grant money? View Quote He can't. The issue is that the grant money comes with strings (guidelines that the state must follow) that currently don't say anything about immigration enforcement. However, come Sept. 30, 2017, that federal funding ends. The next grants start 10-01-2017 and the government agency (congress??) that issues these grants can include stipulations including cooperation with ICE as in honoring ICE immigration detainers, not interfering with ICE officers making arrests on state property, and allowing their state/local LEO's to contact ICE (if they so chose) to report the arrest by them of illegal/out of status aliens that ICE may be interested in interviewing. |

Enough of black robes making law! Complete BS. Withhold the funds anyway. Barry broke the law all the time. He's not in jail.

If that's the case why didn't they just make the EO effective 10/1 and avoid the pissing match? View Quote View All Quotes View All Quotes Quoted:
If that's the case why didn't they just make the EO effective 10/1 and avoid the pissing match? Can't find any details on the effective date. Based on a September 5th deadline to apply for the grant, I'd say the money is for after 1 October. The city will request a decision from the judge before the Sept. 5 deadline to apply for the Byrne grant, Siskel said. |

Federal judge blocks Trump from denying funds to sanctuary cities Federal judge blocks Trump from denying funds to sanctuary cities © Getty A federal judge has blocked the Trump administration's rules requiring so-called sanctuary cities to help enforce federal immigration laws in order to receive funding. U.S. District Judge Harry Leinenweber issued a nationwide preliminary injunction against the Department of Justice (DOJ) on Friday after Attorney General Jeff Sessions announced new rules governing DOJ law enforcement grants, The Chicago Tribune reports. The city of Chicago sued the Trump administration last month over the DOJ’s threat to withhold those grants from "sanctuary cities," which are cities that refuse to help federal authorities enforce immigration laws. Leinenweber said in his 41-page ruling that Chicago had shown a "likelihood of success" in its arguments that Sessions exceeded his authority in July when he announced that the DOJ would withhold public safety grants to sanctuary cities. The judge, who was appointed by former President Ronald Reagan, explained that he halted the DOJ policy nationwide because there is "no reason to think that the legal issues present in this case are restricted to Chicago or that the statutory authority given to the Attorney General would differ in another jurisdiction." http://thehill.com/regulation/court-battles/350937-federal-judge-blocks-trump-from-defunding-sanctuary-cities View Quote he ruled it, now let him enforce it |

Current federal funding cannot be stopped because they already have established agreements in place governing the issuance of these funds which currently do not include immigration enforcement. However, those rules are about to expire come September 30, 2017 which is the end of this federal fiscal year. Which means that the government can write up new rules (these are the strings attached to funding and are not Executive Orders) for the issuance and acceptance by states for federal funds that will be given out to the states for next fiscal year starting 10-01-2017. Those new rules can include requiring that the states honor immigration detainers, allow their law enforcement officers, at their discretion, the freedom to contact ICE and report that they have illegal and/or out of status aliens in their custody on their criminal charges, and agree to not interfere or block ICE officers from arresting illegal/out of status aliens on state property. Next murder by an illegal, arrest the judge for being an accessory and aiding and abetting a violent criminal. And don't obey his orders anyways. View Quote From the article: "Emanuel has been declaring himself a protector of immigrants in the U.S. illegally since before Trump was sworn in, appearing with U.S. Rep. Luis Gutierrez within days of Trump's victory over Hillary Clinton to promise he would stand up for Chicago's "values and principles as it relates to inclusion." |

So basically let's break the law, allow them to continue to break the law, and reward them as well? Yet we wonder what's wrong?
