Justice Clarence Thomas has not been quiet about his anger over the court’s refusal to hear any new Second Amendment cases. In a dissent from the court’s refusal to hear a case challenging California’s 10-day waiting period for gun sales, he wrote that the Second Amendment is a “disfavored right” and the Supreme Court’s “constitutional orphan.” Furthermore, he said that the lower court’s sustaining of the waiting period was “symptomatic of the lower courts’ general failure to afford the Second Amendment the respect due an enumerated constitutional right.” “What this likely means is that we can expect the Supreme Court to start reviewing a few of the more important gun control cases now percolating in the lower courts. Whether the issue is the validity of bans on so-called assault rifles, the length of waiting periods before people can buy guns or requirements for people to receive concealed-carry permits, our nation’s highest court may well start imposing its will on the gun measures of all 50 states and many cities and towns.”

He has more faith in losing gun control than I do. The same as the Dem's are saying good bye Roe V Wade and others. I look any day now for the Dems to say "There goes Brown V Board of Education".

If only Roe V. Wade and 2nd Amendment supporters joined forces. Seems like it would be a fairly large group, maybe a huge majority.

But alas.

Thomas is right.

They were cowards for letting some of these blatant infringements go unchecked. They didn't fancy the 2nd amendment, so they just ignored it. Now we have insanely confusing ideologically opposed precedents.

Military weapons were specifically protected (Miller)
Military weapons may be specifically prohibited (more recent caselaw)

Ta Da. Everything gets to be banned now!

And since intermediate scrutiny allows the weakest justification for prohibitions, requiring no effective evidence just "state interest", the 2nd is useless.

I'm assuming you know there's not a lot of political overlap there, hence the use of 'alas'.  You also surely know that re: abortion and 2A, one of them is actually in the Constitution and one of them isn't.

Contradicting philosophies shouldn't join forces.  Roe is contrary to the pursuit of life and liberty, while the 2A protects life and liberty.

Better tell them to go get all of the abortions they can while they're legal.

We aren't going to ban abortion.
We're just going to pass some common sense abortion control measures.
Nobody wants to ban or confiscate abortion.
Afterall... it's for the children.

Because he is old and we could put someone who could be there 25 plus years.

In my retirement I intend to start a firm that manufactures a Panzerfaust equivalent and command/laser fired EFP mines.  I'll sell them by the conex load to small European countries afraid of Russians.  This will keep the overall price down for the domestic market.

We need precedent forcing strict scrutiny for enumerated rights.

The 2A isn't to Justices that call it a collective right..it's uh something like the right to arm the National Guard or some such non-sense.  .  I see a lot of similarity in how these two issues are argued.  Right to choose...right to self defense.  Yes, not much overlap and not much progress to a true national settlement of either.  As if that would ruin a good chance to keep people in motion.
