Ugh...I would think they would be on the same page when asking technical questions.

Richards is not good at all. He really has no business being a trial lawyer.
KR's Chirafisi should be doing this. If Richards is boring me, he is boring the jury. He needs to be using this witness to create a narrative instead of factoids.

Quoted: The slow mo video couldn't have been more clear. He was assulted while running away, kicked in the face on the ground, battered with a skate board and bicep man advanced on him pointing a gun. There is zero room for anything other than self defense. The defense could not have made it any more clear. View Quote yeah that slow motion video really highlighted the self defense. He was getting swarmed and attacked from multiple directions |

Quoted: Oh I’m sure. From a layman’s perspective though, there just hasn’t been much value added by this testimony so far today. He may prove me wrong as they get rolling, I’m hoping so at least. View Quote View All Quotes View All Quotes Quoted: Quoted: Quoted: Man, you’d like to think that the expert witness testimony would be more impressive. I don’t think this has been much help so far. Oh I’m sure. From a layman’s perspective though, there just hasn’t been much value added by this testimony so far today. He may prove me wrong as they get rolling, I’m hoping so at least. It seems necessary as a rebuttal from the State's cross of KR yesterday Yesterday was all about making KR seem like he hung around and had plenty of time to leave, plenty of time to stop shooting, in each instance Richards is just not great at creating a narrative Remember, lots of people now buy into the whole "shoot to wound" like KR should have shot Rosenbaum in the leg once and then waited to see if he was going to attack him more before shooting again |

Quoted: He’s not dumb, he knows what he’s doing. Time will tell if he flew too close to the sun View Quote View All Quotes View All Quotes Quoted: Quoted: I think Binger is better then people here are giving him credit for. He is an utterly horrible, contempatble shitbird of a human being but even with his condescension and snark towards the judge, he is pulling out all the stops to prosecute his case. He is running into difficulties that he probably doesn't usually face (a judge that is less then friendly towards him) but I bet he has a pretty solid record of convictions as well as throwing cases without getting caught when the agenda deems it. He’s not dumb, he knows what he’s doing. Time will tell if he flew too close to the sun Well the ADA did arrest Kyle in only two days and charge him. That's what happens when you charge too early and start a railroading prosecution.....(i.e., have to play rather underhandly and unfairly IMHO). |
Defense attorney making this much more complicated than it needs to be. Shot zero, time zero, first shot, etc. Just explain it in fucking common sense terms and language. What a choke.
This testimony would be a lot more interesting if they got another uptalk MILF from Northern Wisconsin to do it like the "firearms expert" earlier in the week
The guy in the white beater hit KR in the head and then AH hits him with the skateboard. AH retrieves the board and runs after KR again
Damn. I've got some work to do today, but I keep waiting on the punchline on this.
I can feel myself aging at this point. |

Asking for response to KR cross from yesterday - this should be the whole point
Quoted: Horrible witness prep ... this was an unforced error. View Quote Yes and no. They probably had this prepped perfectly, but the Prosecutions objections threw a curveball into how this was going to be presented. Now it is a choppy unorganized mess. They should have planned for this though or made the same objections to how Binger presented evidence previously. |

Now's the time to watch - rebuttal of KR cross from yesterday

Quoted: Going downhill. This is not really helping. Defense better make it a point to rehash this on closing in a much better flowing commentary View Quote They have to get it in to be able to get it in closing, yes this is boring but a good lawyer will present the timeline at closing in an easily digestible manner for the jury. |

View Quote View All Quotes View All Quotes Quoted: Quoted: Better they did it in the morning but man it's snoozer watching the live stream Pretty sure it is for "we heard testimony that the entirety of these events occurred in..." Yes, they're getting to the point now Furthering defense case, but boring and less effective with the shenanigans and poor prep |

Quoted: ADA got the expert witness and the Defense council off their game View Quote He's all happy because of how confusing he made it. I was balking at the claims Binger is evil. This dude is evil. For him, it's about winning. Hell, I bet he even believes it was self-defense. He's treating this like a game with the only goal being the expansion of his career. He's completely sociopathic and has detached from the concept that this kid might go to jail for life. |

Quoted: People will trash him over wearing a helicopter hook in his armor (yeah its nerdy but who cares?) While smearing an ally of the 2nd. We love eating our own for not passing purity tests. View Quote What is a helicopter hook that you would wear on armor? Are you talking about the trex guy? |

"And reality is three dimensional?"
"At a minimum". lol. I like this guy. |
This seems effective. (the addressing the jury about the limitations of and clarity of hindsight inherent in video)
It pissed me off when Binger kept stopping the video so you couldn't get a feel for the whole narrative.
And now Richards is doing it. Just run everything Black put together in real time as a 3 minute video series, and then we can talk about little pieces of it. |
Getting better finally. They are going to get what they want out of this, but did it in a horrible manner. Should be all tied together neatly in closing.
This took like 30 minutes to get three or four things into the court record
Here's a big one:
While all the shenanigans and the delays getting to this moment were hard to sit through the 1/4 speed is damaging to the prosecution and the testimony that is happening now.
The timeline and times between events Dr Black is testifying to are solid. |
Just because something is captured on video does not mean the people in the video saw the same thing or perceived the same actions.
Nor does it capture events outside the view of the camera. The expert explains that very well. |
Ugh. All of that and then not playing the whole video at real speed. Fail.
Time is precious resource. Diminishing and expendable.
ETA: Never cheap, though |

The DA would be hammering him on pay even if the expert witness was doing this for free. Maybe even more so.

I think the Dr. is going to do more good work on cross than he did on direct
