Agreed.

And I would think with the level of technology in play, one would be able to track every single keystroke punched by a particular individual and every single word uttered, given that they work for “the people”.

Corporations and businesses do it ALL THE TIME and simply have stated to their employees that any and all communication done with their devices/technology is their property.

Why is this so hard?

Similar to every single company vehicle in my company has GPS. They know where you are before you know where you are...

And then they added the forward assist to all rifles to help deal with sticking from dirt, high rates of fire causing expansion, and generally hard use, lack of cleaning from constantly being under fire, etc...

If a drunk driver runs over someone and kills them, he didn't mean it, but still gets charged with manslaughter.

I think what they're saying is that a certain amount of noncompliance is to be expected. Just as speedometers aren't all exactly precise, perhaps they needed to set a baseline of compliance to determine noncompliance. 0-5 over is compliant 5-10 over is mild, 10-15 is worth doing something about. Just a guess though.

I don't disagree with you,  but I don't think your examples are a realistic comparison.

If I walk out of a building with classified material in a notebook , can you prove if I did it intentionally to use for a nefarious purpose or did I accidentally leave it in the notebook when I closed it. It is a security violation regardless.
