Age of Consent is 18 in California. If you're within three years, it's a misdemeanor. More than a three-year age difference and it's a felony. Do you know what percentage of high school students graduate as virgins? I believe it's around 65%, not going to bother looking for the source right now. So this law means you could set up LE at a high school graduation and send every third student off to jail. At least it's only a misdemeanor, but of course they'd have to register as a sex offender.
Stupid laws like that don't ensure minors don't molest other minors. Humans of reproductive age have been banging since the dawn of time. Only recently have we put stupid laws in place to criminalize such behavior. The laws ought to reflect reality, and allow for reasonable close-age exemptions.
The state-to-state variances are especially troubling. In California, a 21-year old banging a 17-year old is a felony. In Colorado, a 41-year old banging a 17-year old is 100% legal. In some states, that goes down to 16 for consent. The states with an 18-year age of consent are ripe for selective enforcement.
