Sounds like they are waiting for a case to make its way through the lower courts. Illinois case is probably on track to hit SCOTUS first. bianchi/snopes from Maryland is ready to be granted cert. it has completely gone through the lower courts and is ready for SCOTUS now. https://www.firearmspolicy.org/bianchi I wondered earlier why I couldn't find it as Bianchi on the SCOTUS website. Eta: It's Snope V Brown now for anyone that didn't click the link and I think the court could stretch out deciding whether or not to hear it until Nov 4. |

I don't understand how this isn't already understood and hashed out, because there's no text history and tradition of serialized guns and there is a history of making guns.. How is this issue even going before The Supreme Court this literally is an open and shut case correct? |

I'm not really educated on this but what does a poly 80 cost to make after molds are set up? I cant imagine it is over 10 bucks. The kit is literally some plastic and 2 pieces of metal, one a KINDA precisely bent sheet metal others are 2 dowels. I cant imagine that either is "hard" to make from scratch. I was kinda suprised when I built my first one and went " am I missing pieces? " and "wow that is it.. ok now gotta valve lap the hell out of it.. " |

The Gov says that the time it takes to complete a gun is determines where it should be regulated. In reality what should it matter if it takes 15 min or 15 hours or 15 days to make a gun? A Bad Actor can take any amount of time to produce guns if that is there will. Nobody is taking a parts kit into a secure area, "drilling one hole" and completing a gun in 15 seconds to commit crime. All Americans share the 2nd amendment right to bear arms. not just those that are skilled enough or smart enough. |

Quoted: I wish they would not refer to guns as ‘weapons’. They can be used as a weapon, but they are inherently a tool. Guns are solely dependent on the user to define their purpose. Every single case since Bruen has essentially been (from the State's side whether plaintiff or defense) a progressively increasingly tortured interpretation of what "historical context" means or what qualifies as such. Yes, it's absolutely as clear as you say. But there's no motivation for the States, agencies, or lower courts to act as if they have a greater than 3rd grade reading level. They all play out like so: BATFE/State makes a rule/law that is obviously in direct contempt of Bruen They get sued. Federal court rules. Losing party appeals. District court rules. Losing party appeals. SCOTUS rules. BATFE/State loses (rarely that clear cut on SCOTUS ruling. Often goes back to lower court with new instructions, etc) But in this case, lets just assume case-closed. BATFE/State makes a rule/law that is obviously in direct contempt of Bruen that is also in direct contempt of the reasoning in SCOTUS previous opinion. They get sued. Federal court rules. Losing party appeals. Di... Repeat forever because the BATFE/State never runs out of money to defund unconstitutional rules/laws and is never sanctioned in any way for continually doing so. Same for the judges of the lower courts that consistently and willfully ignore SCOTUS instructions. |

Anyone can put an aluminum block into a CNC machine and press a button. Anyone can 3D print a "gun". People can make guns with rudimentary hand tools, like Khyber pass guns for example. People can go to the hardware store and put together a functioning "gun". Anyone can drive a car, truck, or van into a crowd of people and cause more carnage than any single gun. Anyone can grab a knife and go on a stabbing spree as you hear about in China and England. You can't live in fear or trample on everyone's rights based on what bad people might do. |

what if my kit includes the design file for your CNC machine and a block of aluminum? is that file and block a gun subject to regulation? Again, we are talking about personally made firearms. its still not legal to take any kit and produce and distribute. ATF's argument is dumb. |

I think anyone here could make an ar15 receiver with a block of wood and tools found in any house in america in eight hours or less. Shitty looking? Possibly yes, but functional. |

The court will destroy such an argument, which is based on ...what? Where is "readily" defined as a fixed, predetermined, 8-hour period? It's arbitrary. |

Earlier: Gov- "some of these kits, all you need to do is drill one hole and bingo bango, GUN! Later: Gov- "well this doesn't apply to MG because you still have to drill one hole..." Attached File |

Quoted: Which 80% lower has these "tabs" that once broken off become a 100% completed receiver? A polymer one I'm assuming? The p80 glock style lowers have tabs that are cut/filed off, but they also require holes drilled in exact spots (using a jig) and then insert the supplied locking block, pin that in place and fit all of the parts into the frame |

It seems the court needs to be reminded that the individual completing the 80% generally needs a solid work bench, vise, router, drilling oil, drill press and a working knowledge of these items before turning it into a functioning firearm. |

That hard part for me would be getting the buffer tube threading right. The interesting thing about this case is if it goes our way, the auto key card folks should be exonerated, and even putting a dimple or mark for a third hole should be legal as long as you don't drill it all the way through. The whole concept of "readily convertible" needs to die. And if SCOTUS rules correctly, a pile of parts shouldn't be a gun even if it can be assembled into one. |
