I don't know if you can get 40mm stuff (even demilled).  You can get 37mm stuff.  I'm pretty sure you can't buy 40mm live stuff even if it's training stuff.

Isn't most of that toy stuff 37mm as opposed to 40mm?

If so, yeah, you can buy and sell it. Some of it may require HAZMAT charges on shipping (don;t know this, just guessing). And this is just smoke and flares and that sort of stuff. They might even make bird bombs for them, but I'm unsure.

People who own 40mm GLs buy the TP rounds.  They aren't a DD in themselves.  No tax, etc. for each round, like the HEDP, etc.

People also reload them, using the spent cases, powder, and .38 blanks as the primers.

They are 100% legal and fun.  I have a couple of cases.  Nothing better than shooting one up on the berm.  The velocity of the projectile is slow enough you can watch it in flight.
