This is correct. Must come from the factory without ever having a buttstock to be classed as an AOW. |
If you buy an factory AOW shotgun it will only come with a pistol grip installed. You can't put a buttstock on it unless you pay the $200.00 tax to convert it to a SBS, then if you did that you could put a buttstock or a pistol grip on it. |
As long it was bought with a pistol grip in the original factory configuration it is an AOW. If it left the factory with a buttstock, JoeBlow bought a pistol grip and chopped the barrel down and tried to sell it to you as an AOW, it would not fly. It would still be an SBS in spite of the fact that you bought it from JoeBlow with a pistol grip installed. |

I believe that you can actually file a Form 1 and build an AOW from an existing shotgun, but you would have to put a pistol grip on the weapon, and pay a $200 tax to build the weapon initially. After that, if you were to transfer it to anyone else, it would transfer with a $5 AOW stamp. Or, you could paper it as a SBS, and it could have a stock, and would transfer with a $200 tax. Yes, but building an AOW involves paying a $200.00 tax stamp opposed to paying a $5.00 tax for transferring a factory AOW. If you bought a Mossberg JIC and decided you wanted to shorten the barrel you would be better off registering it as a SBS and paying the $200.00 tax so you could put a stock or pistol grip on it. |
