a federal grand jury, or judge, can authorize a warrant based on "evidence" presented to them, pending "investigation"
this way by showing without said evidence they cannot make an arrest. Once they have the "alledged evidence" they proceed to make a case. a warrant does not an arrest during the search, and or afterwards, make. it is more for evidence gathering than anything else. we all know the ATF is not going to test a weapon for "irregularities" in the field. that is done behind closed doors in a "controlled enviroment" then if an illegal weapon is found the arrest follows. |
