They can not do that it violates the 2nd.  You are allowed to keep guns in your apartment.  If you were to be attacked at gun point with in youre apartment you could sue the hell out of them for them not allowing you do adquetly defend your self.

On the lease what you are refering to is actually carring a gun on the property not keeping one in your apartment.  If you have a CHL then the carrying part does not apply to you.  Whatever state you live in you call the local apartment asociation to verifty that it is legal to carry a gun while on property with a CHL.

Worse case if for some crazy reason they have the authority in your state to keep you from carrying a hand gun on property they could evict you.

Yup in the lease it states you will call the courtesy officer to take care of any problems. The officer who lives on propertry is usually a cop.

If you make the office notate in that persons file about the noise complaint you can have them evicted after 2-3 complaints.

I had a lease where the landlord paid for water.  If I wanted to break that lease, could I use constantly letting every faucet run full blast as leverage?

WRONG. My family does apartments for a living. When entering a binding legal contract (and lease agreements are) you are agreeing to follow the rules and regulations set forth in said contract. If it says no guns, the second doesn't apply because it's on private property.  We've used this clause 4-5 times to do forced evictions, with judges approval after they wouldn't approve forced evictions for other things like non payment of rent, failure to keep all utilities on and other repeated rules violations.  We wait and file on the day that the local libtard judge will be getting those cases, and we file based on that. Boom, sheriff's deputies force them out.  

All 100% legal with judges signatures.   In this game you have to be dirty, and when taking out the trash, it pays to have every ace in the hole.

You cannot forbid firearms in a residential rental property in Texas, even if it's in the contract.



Generally* If it's not illegal, and doesn't adversely affect the property or other tenants, it's none of the landlord's business.



The landlord loses some rights to the property when they choose to rent to the public.

Basically we were told about a policy when it comes to breaking leases separate from the written one at the time of signing. That gov't employees could get a waiver. Now she's saying she doesn't do it, and admitited they've done it recently but said she's holding us to it.

It's annoying.

5 months ago I gave 35 days notice to move.  I moved
Gave what in my mind was 5 days of "buffer"

Today I get a call fm a collection agency

Sems I owe an assload of money

I objected    stated. Did give notice
She read the clause ..  It required 60 days!!



My fault I screwed up



How fucked am I ?

Long story short:

last place:

-didn't fix anything.
-went condo, and the renovators put sand in the back of my dad's pickup and the office people couldn't say who did it...brand new '06 Silverado.
-the damn renovators weedwhacked my mom's garden, the one the people said in 2000 we could plant.
-did I mention didn't fix anything?

place before that, the concept of snow removal was a foreign art to them.

i work in the apartment industry and simply by the way the op stated his qualifications in his post i can tell you i know more about it then he will.

you are fucked. if you fail to give proper notice you will be required to pay whatever fees you are legally required to as stated in the contract, which vary greatly and depened heavily on state laws. your best bet is to read your lease. most are very simple and precise in their wording and are quite clear in spelling out the legal responsibities of both the renter and rentee.

if you dont pay it will end up on your credit. it will show up whenever they pull your credit if you try to rent again and they will deny you.

Many leasing agents and even property managers don't fully understand the contracts they're asking you to sign, they're just passing off what they've been told it says.  The property manager's supervisor is typically an incompetent political appointee but that's who you'd usually need to talk to (nicely) to make any headway.  One Mgt Co I worked for had explicitly told us that changes in 2000-something allowed people joining the military to break their lease with minimal penalty (30 days notice + repay any discounts taken).  What they figured out later was (and I had pointed this out in that meeting months earlier) that you had to be enlisted at the time of signing, and received a PCS (not just deployment).  Of course they never informed the leasing staff of their change in stance, and we had a couple residents join or get deployed later.  Nearly lost my job, but raised enough hell to get them to honor their promise even though it wasn't in writing.  Communication between upper management and on-site staff is nearly nonexistant.

True for the most part.  The most reputable management companies are very by the book, though it might not be best for your situation they'll follow the contract to the letter.



Smaller management companies can be more flexible with rules, but there's usually going to be a trade-off in my experience.

You'll be held responsible for the remaining 25 days unless they moved someone into your apartment before the end of the required notice period, then you're only responsible for the rent (probably at a higher month to month rate) up until the day they moved in.  You can ask to see proof that it was vacant through that 60 days if you don't trust them.  They should have sent you a renewal notice stating lease expiration, renewal rate, and month-to-month rate 60 days +5 business days in advance of your expiration (most will post the notice on your door instead of mailing it).  If they didn't send a notice (they're not required to if there's no increase or change in terms) then your rate should be what you were paying unless you received a prorated or monthly discount (should be under special provisions on the bottom left of a TAA contract if they haven't changed it in the last couple years).  I would always call a resident to let them know their notice was improper so they could plan around it.  60, and even 90+day notices have gotten popular.

They really should start licensing at least the property managers here in TX.  You wouldn't believe the retarded motherfuckers that are in charge of 1000-unit A/B properties (well, being in the business you probably do
).  Fair Housing is the biggest fucking boogeyman in the industry.  One slobbering man-hating bitch of a manager said we were no longer allowed to discriminate against people with large dogs becasuse of FHA
.  Never failed, come back after 20 minutes of selling the property and everyone that didn't fit her appearance standards (99% of the time they had too much pigment) she'd start wagging her finger and saying 'no way, we don't want that kind of tenant here'.  I'd carry on and work harder get them qualified and that worthless POS would pour over the app, rerun credit/criminal check, require them to come in for an interview
, everything she could do to deny them.  I hated working for that company, week before I quit I leased six apartments to a band of Gypsies.  They lived there until the Constable kicked them out four months later
.  I felt bad for my coworkers but they said it was worth watching her have a nervous breakdown and quitting.  They lost the management contract a couple months later.

On the first page of the lease contract it will state if a 30 or 60 day notice to vacate is required.  Get a copy of your old lease from the apartment complex by law they have to keep it I beileve 5 years.  Check to see which one it was.  If it was a 60 yes your fucked. Second they should have mentioned it to you when you handed in your 30.

In Texas it does not effect youre credit score, as in the same way a debt for a medical bill does not if you want proof, seach on google there are lots of infromation on how owing money to an apartment complex does not effect your score in most states, it just effects youre ability to rent again.
