I was messing around with a Daniel Defense AR at Gun Gallery a few days ago, when I thought of something. Newer GI-type magazines have no date code on them. The one in this particular gun had no markings of any kind (even on the floor plate).

Whereas I realize it would be illegal to attempt to pass off said magazine as preban in New York (or another ban state with comparable law), what is the practical restraint?

I am in no way suggesting people should attempt to break the law in this manner, but it made me wonder. And since I have no real exposure to ban state practices, I thought if I asked the question here, someone would explain it to me.

So what is the practical reason an unmarked post-1994 magazine could not be passed off as pre-ban in a ban state?

I wouldn't think there is a practical reason, as long as you could identify the manufacturer and that the mag could have been made in the required timeframe, then there's no way to prove beyond a reasonable doubt. But you're putting your shit in the hands of the jurors.

If anything, this argument just goes to show how fucking retarded the whole thing is. If liberals could think logically and you showed them two mags, one preban and one not, and tell them one's legal there whereas the other isn't (or CA's rebuild kits) and watch their eyes bulge out like this . Problem is liberals and logic don't mix.

Sure that there are no markings anywhere? Even a number next to or around the company logo on the baseplt

Well sure, I realize mag capacity limits are stupid and arbitrary. Weren't there a lot of unmarked floor plates before the ban? Even if there weren't, usable floor plates with old markings are all over the place. Maybe what I'm talking about is already a common practice––I have no idea, lol.

Burden of proof is on the prosecution, no date codes then no proof.

What magazines? O those magazines......well I lost them in a unfortunate canoeing accident

I have preban magazines that you would need to know the manufacture and when they were in business (pre 94 ban). They are not marked except for the manufacture information. I do not use them.

I only use high cap magazines that are marked with the date on the outside. And thats when I use them. I conserve more ammo and shoot  better when using 5 and 10 round magazines. Better safe than really sorry.

Some brands went out of business before the ban.  Some, started putting markings on after a certain date.



There's some websites dedicated to this.




I think I have 5-6 preban mags I need to sell, actually.  I don't use them, and they need to be in the hands of someone who will.

I need to dig out more Colt mags to sell to NY'ers behind the lines.  I sold some a few years ago. Just wanted enough out of them to get new ones to replace them. .
Need to dig them out and see how many I have.

I don't have an answer to that. But I will throw out a WAG and say it's probably a possession/strict liability crime that (at least for the lowest potential charges) don't require intent.

My part-time boss (gun/surplus store) has dozens and dozens of pre-ban 20 and 30 round magazines. I keep telling him to put them online so they can go to ban-state people, but he's too lazy. Plus he doesn't have the money to pay to sell them on the EE where they'd actually go to ban-state people.

If you're talking companys. We in hawaii even thought this. You dont want to put a date on them if selling to a non ban state.

Did you take a close look at the inside of the magazine.

For example, NHMTG magazines are stamped on the outside and the inside (inside stamp can be hard to see).  I don't recall if the inside stamp has the date - maybe just NHMTG.  I don't think that NHMTG existed before the ban.
