Say a kid hits a foul ball at a little league game and it goes through someone's windshield. Who is responsible? Are the parents of the batting kid supposed to pay for it or is it just a hazard of being at a game?

Pretty sure my insurance is paying for that one.  Those of use with ballpark experience don't park there.

Shit happens. Buy yourself a new windshield.

If you don't like the custom windshield get a new one - and pay for it.

No one forced you to park there.

The kid didn't park your car.

It's your car, so why should anyone else pay for your windshield?

That's why you buy insurance - because shit happens.

Some 20 years ago there was actually a court case where some asshole tried to sue the city or what not for damages. Judge ruled that such things are an accepted hazard of parking near a ballpark, and sharply criticized the plaintiff. My Google fu is failing me, though.

If you weren't smart enough to not park in the danger zone before, I bet you are now.

Its hard for anyone to believe that the kid intentionally hit the ball with exactly the force needed to cause the damage incurred.

Seen foul balls hit cars many times. Car owner assumes the risk by parking there.

Actually the child is liable, I would lawyer up immediately. If you are concerned about his ability to pay, you can probably get a court order to force him to liquidate his baseball card collection.

Batter not responsible.
I have seen many cars hit over the years and it is on the car owner.

This happens all the time, never park anywhere near the fields - go at least 500-600ft away. As a player, I took out more than a few windshields with foul balls. Oh yeah - it's on the owner / insurance - not player or fields.

Hazard of the game.  That's why I always park in a place that is not easy for a ball to get to.  It was hilarious watching the ex's car get hit severalist times, in one game, last year.  Cracked windshield, dented roof and hood.  Even broke her Sideview mirror, compliments of one of our kids.  It was a good day.

Some time around 88 Im coaching LL and a foul ball broke a windshield on a minvan.

Fat yuppie quicheapottamus starts demanding the league pay for it.

She parked right in front of a sign that said no parking -reseved for equipment van.:)

I called the precinct and had a buddy ticket her fat ass.

Which child? Batter only hits the ball because the pitcher threw an unsuccessful pitch.

Still the batters fault because he didn't barrel it up.

IIRC MLB baseball tickets used to contain a disclaimer against injury and damage.  If you enter the park you accept the risk.

you are liable for the damage.> However i have never seen a baseball park where the balls fly towards cars. Seems like bad planning to me.

If the game was in stadium, it's on the auto owner.
If the game was in a Walmart parking lot, it's on the kid.

The last windshield I bought was around $200.  I didn't even bother filing an insurance claim.

I don't know why I got all the "you are responsible" replies. I never said it was my windshield. Actually what prompted the question was my son hit a foul ball and it smacked a newish Toyota pickup. We know the owner and they know us. Not really friends I would say rather the kind of people you just say hi to when you see them. Anyway they didn't say anything about it but it has been kind of awkward since it happened and I didn't know if I should have offered to help with the damages or what.

Given that, yeah, hand the guy a c-note & apologize for taking your time. They'll appreciate, you get good karma.

Fact: DangerJ scored three runs and large quantities of high fives by hitting a ball over the fence just right of center field.

The sister of some guy on the other team decided to park her brand new Eclipse just 20 feet behind the fence.

My ball landed square in her windshield.

"Well, you shouldn't have parked there, dumbass" was the verdict.

In FL, a windshield claim has zero effect on rates.

That said - there is some assumption of the risk when parking or driving around a ball field.

Back in the day, my dad got his roof dented by a foul ball at a ballpark.  He ultimately was able to make the batter's family use their insurance to pay for it.

The batter was my brother.

I have to think the owner of the car is responsible.

My kid has been in baseball since he was 5.  When I go to his games now at age 15-16, you have kids hitting the ball 350-400 feet.  Saw it happen twice last week. Some of these kids are monster hitters.  I NEVER park just beyond an outfield wall.  I even park 50 yards behind it to account for the bounce after it hits the parking lot.

I'd demand a full replacement by the windshield manufacturer if a baseball went through it.  If it only bounced off a spider webbed the windshield, that's on the car owner.
