was up hiking out in the middle of nowhere scouting some indian ruins
and whatnot up in the woods and found this can buried under a pile of
stones on top of a mountain earlier today.  Contains the a mining claim
deed and locations from 1960 for the area.  Didn't have time to seek out
the mine but it has directions to find it .   Not a lot of gold in the
area and it doesn't describe what they found .    Ill go back up there
in a couple weeks to see if I can find what they were mining.  



There are no trails or anything going up to this mountain so Im pretty sure the claim hasn't been used in a LONG time if at all but maybe Ill find something neat up there.

That is legally how it was done.   That claim might still be private property.

Possibly a uranium mine site or potential site.

Look up the location on http://www.geocommunicator.gov/blmMap/Map.jsp?MAP=LAND, hit the mining claim button in the upper right hand corner.

Finding claim documents like that around here is very common. You should check with the county recorders office to see if the annual improvements are up to date. Mining laws vary by state.  Most old claims lapse and revert back to the gubment.

Is it a "Notice of Location"?  "Affidavit of Assessment Work"?

I doubt it is a deed.

You should return it to where the owner posted it.

To answer your question, though, removing it makes you a claim jumper.

in MT it's annual, and the claim has to be actively worked during that year.  




don't know anything about AZ.

this, unless the OP knows for a fact that it's outdated based on AZ law.




that said, it's highly unlikely that a 1960 claim is still current, since the whole point of posting is so that miners actively work the claim instead of just keeping the claim 'off the market'.  as i wrote above, in MT you have to re-post every year, and if you're even 1 day late, someone else can jump it.

Years ago, one of my idiot brother's friends showed up with a jar with a 1951 Notice of Location for the "Mexican Massacre Mine".  The Locater wrote quite a narrative.  Then I told him to put it back where he found it.

Federal, unless the mining district has some weird bylaws.

 



I would put that back, that is someones corner marker with all the legal info for their claim, regardless of how old it may be the upkeep on a claim can be paid, $200 for two years I beleive.

I'm into prospecting. I'm actually the Vice President of the southern gold miners association here in Ga.

You can send it to me for proper disposal.

As for laws: if it is a verifiable claim it could still be valid. Mining laws are very strict but also very solid once a claim is filed.

You can also google earth the location and there are several websites that will overlay existing or past mining claim locations.

Sounds like you have a dam fine treasure hunt. And yes there is still a lot of gold in Arizona.
