Hi.  I'm really not sure how to handle this, and I'd appreciate some insight.


June 2006 a buddy [he's Marine, I'm AF] asked who could co-sign for his laptop.  Stupidly, I agreed.

He purchased a $3,000 Dell laptop; Dell was supposed to transfer the charge account
over to him after 2 complete payments, but it turns out that isn't possible.  [damn]


The short version is that he hasn't been paying me since the superbowl.  I'm out of pocket
over $500, and holding the bag on most of the rest.

How can I go about collecting the outstanding funds?

We're now under different commands [I was transferred to a different base], and I've called
him repeatedly about this.  He frequently says that he'll send me a few hundred, but
doesn't come through.

Is it possible to put a private debt out for collection?

Can I, a private person in a different state, attach his bank account?

Something else?

You can't attach any of his assets without a judgment.  You are going to need to bring an action against him in small claims court, depending on your jurisdiction of course.

You have to have a judgement before you can get to his bank account.

You need sue in small claims court.  

My guess, based on his prior actions, is that he won't show and you'll get a summary judgement.

On the off chance he shows, make sure you have all your paperwork squared away to prove your case.

Hiring a lawyer would be pointless due to the small amount of the debt vs. the large amount to retain a lawyer.  

Have you brought this to his CO's attention?  I'm not mil but I thought COs do not look kindly on this shit.

Contact his CO and explain the problem.
You can also talk to JAG at your station and see if they can provide any help or guidance.
If you do not have some type of written agreement with him, you may be SOL.

Oddly enough, he 'decided' to come though with a western union for some cash  since this happened, and I was able to use your info to make intelligent comments.
